和谐法治论纲

【摘要】：法治(rule of law)是当今世界最突出的合法化政治理想。然而,源自西方传统的法治究竟是西方社会特有的现象还是整个人类社会的共同现象?西方的法治理论和西方国家的法治发展道路对于中国究竟有什么样的意义?在一个没有法治传统的国家如何实现法治?作为地方性知识,中国的法治发展有什么特殊性?中国的法治发展有什么样的社会动力和将面临哪些困难?中国将走什么样的法治发展道路?如何将执政党“建构社会主义和谐社会”的战略构想与宪法中“依法治国,建设社会主义法治国家”的宪政方案有机地结合在一起,探索中国法治发展的理想模式?这些不仅是重大的理论问题,而且是重大的时代课题。正是对这个时代课题的理论回应和现实关切,中国法学界创造性提出了构建“和谐法治”的新命题,标志着中国特色社会主义法治发展理想图景破茧而出。纵观中国法治发展进程,其每一阶段无不发端于一定的社会经济生活条件。当代中国正经历着由传统社会向现代社会的历史变迁和巨大转型。在社会转型不断加快的背景下,在构建和谐社会的时代主题中,中国法理学要推动法治思想在中国语境下的生长,并进而实现中国法理学在国际结构中的自主发展,就必须在审视中国特殊国情和本土资源的基础上,继承和发展西方法治文明的优秀成果,推动形成具有中国特色的法治发展道路。法治的中国特色,不仅在于它要保障般意义上的正义、自由、秩序、效率,而且更要保障和谐。“和谐法治”的提出,正适应了当下中国法治建设的这种需求,充分体现着构建社会主义和谐社会的战略思想和中国特色社会主义的时代精神,代表着我国依法治国方略和法治国家目标的历史走向。正因如此,一段时间以来,“和谐法治”问题成为法学研究的重要领域,一些有洞见的研究厘清了许多理论问题,取得了很多开创性成果,推动了“和谐法治”研究的深入。但毕竟“和谐法治”的研究起步不久,对这个新范畴的研究还没有引起足够重视。因此,本文的研究目的,就是对这个新范畴作个整体性的探究,以期引起法学理论界对这个问题的进一步关注为了达到整体性探究的目的,本文从“和谐法治”这个核心概念出发,从法治思想的知识脉络、学术传承和中国法治发展的本土资源着手,在分析、汲取现有研究成果基础上,对这个新范畴的内涵、特性、内在理路、理论意象、实践指向作一个整体性的讨论,试图开放出这个论域的一般性问题,形成“和谐法治”研究的整体性理论框架。本文从分析法的和谐价值入手,提出法的和谐价值的彰显必然引起法价值体系的重构,法价值体系的重构必定引起法律体系的重塑,而这正蕴含或决定着中国特色社会主义法治的价值取向、基本原则、制度安排,指引和制约着对法律资源的社会性配置。和谐法治就是把法的和谐精神导入法律体系,以法的和谐价值融入法治发展的各领域和全过程,指导法治实践,引领法治发展。和谐法治的要义在于建立一个自由有序、充满活力的和谐社会,实现良法善治。同时,本文试图从法治发展的西方传统和中国探求两条进路,提出“和谐法治”不仅是推动法治思想在中国语境下生长的最新努力,也是中国法学参与或引领世界法律对话的一种理论范式,是中国法理学在国际结构中的自主发展的最新成果。在西方法治传统蜕变和中国法治发展面临困境的双重背景下,和谐法治范畴的提出和展开,是构建具有中国特色、中国气派、中国风格和具有世界影响力的法学理论体系的尝试,不仅将成为中国特色社会主义法治发展的理想图景,而且也将成为重构人类社会法律哲学和法律体系的起点。从整体性的视角,本文对“和谐法治”问题作了一些新的论述,主要是：明确提出“和谐法治是中国特色社会主义法治发展的理想图景”；首次对法的和谐价值的基本属性进行了讨论,提出法的和谐价值具有统合性、超越性、社会本位性、非根据性的基本属性；首次讨论了法的和谐价值与法的正义、自由、人权、秩序、效率等基本价值的关系,提出了法的和谐价值导入与法价值体系重构的问题；以“和谐法治”这个新范畴为基础,对这个新范畴的内涵、特性、内在理路、理论意象、实践指向作一个整体性的讨论、探究,开放出这个论域的一般性问题；对和谐法治生成的条件作了分析。 “和谐法治”范畴的提出具有重大的开创性意义。“和谐法治”是以主体性话语回应时代课题的理想选项,体现了我国依法治国方略和法治国家目标的历史指向。“和谐法治”研究的展开和深入势必会引发法本质、法价值、法功能和法作用理论的变迁,引领我们转换法治话语体系,进而引起整个法律观的重构,提升我们的法治观念和法治实践,丰富和创新建设社会主义法治国家的理想模式、历史任务、实践途径。
