法治测量中的误区

【摘要】：利用指标体系对法治水平进行测量是法治研究中的一个新兴领域。在设定指标体系的过程中,研究者往往会面临抽象概念的概念化、测量方法以及指标体系功能导向等三个方面存在的问题。这些问题的背后是三组存在一定冲突性的指标体系功能预期,包括指标的全面性与代表性、数据的主观性与客观性以及指标导向性与信度。在指标体系的具体设计过程中,研究者一方面需要对其功能预期有清晰的认识,另一方面需要借助一些方法来避免或减少上述问题。
[Abstract]:Using index system to measure the level of rule of law is a new field in the study of rule of law. In the process of setting index system, researchers often face three problems: conceptualization of abstract concept, measurement method and function orientation of index system. Behind these problems are the functional expectations of the three groups of indicators, including the comprehensiveness and representativeness of the indicators, the subjectivity and objectivity of the data, and the guidance and reliability of the indicators. In the process of designing the index system, on the one hand, researchers need to have a clear understanding of its function expectation, on the other hand, some methods are needed to avoid or reduce the above problems.
