《中国评论》中的中国法律及其研究价值

【摘要】：《中国评论》(The China Review:Or,Notes and Queries on the Far East,1872-1901)是19世纪末期中西文化交流史上的主导性媒介,所刊有关中国法律和习俗的文章多,内容丰富,包括摘译《大清律例》、《洗冤录》和《刑案汇览》,专文论述中国古代法律传统及《大清会典》,评述中国法律的实施,介绍中国的官制、刑法、监狱、婚姻、继承、收养、商事等。与《中国丛报》相比,《中国评论》关注中国法律的范围、侧重点和论述方法均有明显变化。对于中国法律典籍西译史的深入研究、19世纪西方人中国法律观变迁史的总结等比较法律史的诸多论题,《中国评论》都有重要价值。
[Abstract]:"China Review" (The China Review:Or,Notes and Queries on the Far East,1872-1901) is the dominant medium in the history of cultural exchange between China and the West in the late 19th century. Including the excerpts of the Qing Dynasty laws and regulations, the record of the clean-up of grievances, and the Summary of Criminal cases, the article deals with the ancient Chinese legal tradition and the Qing Dynasty Code, reviews the implementation of Chinese law, introduces China's official system, criminal law, prison, marriage, inheritance, adoption, Commercial, etc. Compared with China Cong newspaper, China Review focuses on the scope, emphasis and discussion of Chinese law. The Review of China is of great value to the in-depth study of the western translation of Chinese legal books and the summary of the history of the changes of Chinese legal views in the 19th century.
