维柯“诗性法律”阐释的原创性及其现实启示

【摘要】：维柯的"诗性法律"阐释表现为思想领域、研究方法、法律观的"三重原创性",由此窥见一种遍布世界各民族中的人性光辉,维柯用诗性的语言预演了人类"现代大同世界(modern world of nations)的历程"。"诗性法律"通过阐释诗性智慧揭示了人类文化结构中最本质最优秀的文化因子,它给予我们一定的现实启示:一是中国社会调整机制需要诗性的文化亲和力和文化创造力;二是中国的市场经济体制需要借鉴诗性文化传统提升其价值和谐度;三是在构筑"后发型"、"追赶型"的中国法制现代化大厦中,需要民族习惯法的诗性文化元素和传统智慧的支撑。
[Abstract]:Vico's interpretation of "poetic law" is manifested in the "triple originality" in the field of thought, research methods and legal view, which reveals the brilliance of human nature in all nations of the world. Vico rehearsed the course of (modern world of nations) in the modern world of Datong in poetic language. Poetic law reveals the most essential and excellent cultural factors in human cultural structure by explaining poetic wisdom. It gives us some practical enlightenment: first, Chinese social adjustment mechanism needs poetic cultural affinity and cultural creativity; Second, China's market economic system needs to learn from the poetic cultural tradition to enhance its value harmony; Thirdly, in the building of "post hairstyle" and "catch-up style", the Chinese legal system needs the support of poetic cultural elements and traditional wisdom of national customary law.
