检察机关法律监督的定位与缺失

【摘要】：人民检察院是我国的法律监督机构,其所享有的法律监督权是我国权力分配的结果。但是,对人民检察院进行法律监督存在缺失,尤其是检察院直接侦查起诉的案件,偏离了法律监督的位置,缺少被监督的法律环节,不符合分权与制衡原则。检察机关要享有对案件直接侦查的法律权力,就必须解决如何进行法律监督的问题。
[Abstract]:The people's procuratorate is the legal supervisory organ of our country, and the legal supervision power it enjoys is the result of the distribution of power in our country. However, there is a lack of legal supervision over the people's procuratorate, especially the procuratorate's direct investigation and prosecution of cases. It deviates from the position of legal supervision, lacks the supervised legal links, and does not conform to the principle of separation of powers and checks and balances. If the procuratorial organ wants to enjoy the legal power of direct investigation of cases, it must solve the problem of how to carry out legal supervision.
