完善河北省医疗纠纷人民调解机制研究

【摘要】：目的医疗纠纷人民调解是解决医疗纠纷的新途径。河北省已在各地积极推行医疗纠纷人民调解机制，并取得了一定的成效。但是，由于种种原因，各地的医疗纠纷人民调解工作进展不一，已开展医疗纠纷人民调解工作的地方也存在一定的困难和问题。本文对国内外医疗纠纷调解的经验进行了借鉴，并对河北省目前医疗纠纷人民调解中存在的问题进行了分析，提出了完善河北省医疗纠纷人民调解的建议和对策，期望能够对进一步改进和完善河北省医疗纠纷人民调解工作有所助益，促进医疗纠纷的合理、合法地解决，构建和谐的医患关系，保证医疗卫生事业的健康、顺利发展。方法1文献检索法运用文献检索法，收集相关专家学者有关医疗纠纷调解的研究文献、相关机构和人员提供的的资料和信息。文献的主要来源包括HealthSTAR等外文数据库，CNKI、维普、方正、知网等中文数据库，河北省司法厅、卫生厅等网站、GOOGLE搜索网站等。通过文献检索法系统地掌握国内外有关医疗调解的研究成果，了解医疗纠纷人民调解的研究现状、取得的成绩、成功的做法、存在的问题等。 2资料分析方法通过文献检索法和访谈法得到的资料多为定性资料。主要运用归纳、演绎、推论等方法，对定性资料进行整理和分析 3访谈法根据设计好的访谈提纲进行访谈。访谈对象为医疗纠纷人民调解委员会的调解员、医疗机构负责医疗纠纷处理的工作人员。访谈内容主要为医疗纠纷人民调解与其他解决医疗纠纷的方式相比具有的优势、目前医疗纠纷人民调解机制存在的主要问题、对完善医疗纠纷人民调解的建议等。结果1河北省面临着较为严重的医患关系问题，许多医院深受医疗纠纷的困扰，希望能够依法解决医疗纠纷，医疗纠纷人民调解是一种较好的方式。 2河北省重视医疗纠纷人民工作的开展，政府积极支持、督促各地建立医疗纠纷人民调解委员会，在办公场所、经费、人员等方面给予帮助。但医疗纠纷人民调解工作总体落后，且各地发展不平衡。 3河北省医疗纠纷人民调解工作的主要问题有：许多地方组建医疗纠纷人民调解委员会滞后于司法部、卫计委等部委的要求；医疗纠纷人民调解委员会调解的纠纷数量不多，尚未成为医疗纠纷解决的主渠道；调解员素质有待提高等。结论1医疗纠纷人民调解以其经济性、便捷性、民间性等特点，在解决医疗纠纷、化解医患矛盾中有其突出的优势，应当大力推广。 2针对河北省医疗纠纷人民调解工作中存在的问题，本研究提出了相应的完善策略和措施：加强政府在医疗纠纷人民调解机制建设中的作用；建立健全医疗纠纷人民调解的保障机制；加强医疗纠纷人民调解的宣传；加强医疗纠纷人民调解员队伍建设；规范医疗纠纷人民调解委员会的调解活动；完善医疗责任保险制度；做好医疗纠纷人民调解与司法程序的衔接。
[Abstract]:The purpose of medical dispute mediation is a new way to solve medical disputes. Hebei province has in all localities to actively promote people's mediation mechanism of medical disputes, and achieved certain results. 2, data obtained by literature search and interview are mostly qualitative data. The methods of induction, deduction and inference are used to collate and analyze qualitative data.

The main content of interview for the people's medical dispute mediation has advantages compared with other medical disputes, the main problems of people's mediation mechanism of medical disputes at present.
