公诉办案风险评估预警机制研究

【摘要】：2010年初，《最高人民检察院关于深入推进社会矛盾化解、社会管理创新、公正廉洁执法的实施意见》对建立健全执法办案风险评估预警机制提出了明确要求。近年来，各地检察机关积极建立执法办案风险评估预警机制，取得了一定成效，但较多执眼于检察机关控申部门。公诉部门作为检察机关的重要职能部门，在深入推进社会矛盾化解、社会管理创新、公正廉洁执法三项重点工作中承担重要角色。在公诉条线建立和运行风险评估预警机制，切实加强公诉办案风险的预警防范，提高办案质量和办案效果是形势和任务的迫切需要，势在必行。本文即在此背景下，对各地开展办案风险评估预警机制的状况进行调研，考察了其他学者的研究成果，夯实理论基础，，引入风险管理学的基本理念，并试图结合公诉办案实际情况给出风险评估预警机制及配套机制的设计方案，以指导实践。本文主要分四个部分，一是采用比较分析法厘清基本概念、引入风险管理学基本理念，明确公诉办案风险管理“事前预防”的基本思路；二是采用实证分析法研究建立该机制的时代背景、必要性以及各地检察机关的实践成效；三是对该制度的基本构架进行创设，从主体、客体、风险点的确认、风险等级、评估时间、预警报告等角度确定具体设计方案；四是设计信息沟通、侦捕诉联动、公诉人资源调配、舆情应对等配套机制。
[Abstract]:At the beginning of 2010, the opinions of the Supreme people's Procuratorate on how to promote the resolution of social contradictions, the innovation of social management, and the impartial and honest enforcement of law put forward a clear request for establishing and perfecting the risk assessment and early warning mechanism for handling law enforcement cases.In recent years, procuratorial organs in various localities have actively established an early warning mechanism for risk assessment in law enforcement and handling cases, and have achieved certain results, but they have paid more attention to the prosecution and application departments of procuratorial organs.As an important functional department of the procuratorial organ, the public prosecution department plays an important role in the three key tasks of promoting the resolution of social contradictions, the innovation of social management and the impartial and honest enforcement of law.It is an urgent need of situation and task to establish and run the risk assessment early warning mechanism in the line of public prosecution, to strengthen the precaution of public prosecution case handling risk, to improve the quality of handling cases and the result of handling cases.Under this background, this paper investigates the situation of risk assessment and early warning mechanism in various places, investigates the research results of other scholars, solidifies the theoretical foundation, and introduces the basic concept of risk management.In order to guide the practice, this paper tries to give the design scheme of the risk assessment and early warning mechanism according to the actual situation of handling public prosecution cases.This paper is mainly divided into four parts: first, using comparative analysis method to clarify the basic concepts, introducing the basic concept of risk management, and clarifying the basic thinking of "pre-prevention" in the risk management of public prosecution cases;The second is to use the empirical analysis method to study the background and necessity of the establishment of the mechanism, as well as the practical results of the procuratorial organs in various places; third, to create the basic framework of the system, from the main body, the object, the risk point confirmation, the risk level,Evaluation time, early warning report and other angles to determine the specific design scheme; fourth, design information communication, arrest and prosecution linkage, public prosecutor resource allocation, public opinion response and other supporting mechanisms.
