论司法审判权的新闻监督

【摘要】：包括审判独立在内的司法独立与以新闻监督为主的社会监督的关系,也就是司法与传媒的关系,是社会主义法治化建设进程中的一个重要而敏感的问题。社会各界对二者之间关系的争论由来已久,从未停歇。激烈的争论一方面将二者冲突一面的枝末细节都展露无疑,另一方面也引发了大众对调和二者关系的深入思考。任何一个事物都有其两面性,审判独立和新闻监督之间既有冲突也有互助,新闻监督在促进公正司法的同时也冲击司法的独立性,尤其是审判独立;审判独立要求一个相对封闭,能够尽可能的排除外界环境和因素干扰的空间,也就天然的会对新闻监督有排斥的心理。因此,如何划定两种权利的行使界限,构建二者之间的平衡点,是司法实践中亟需解决的现实问题。也正是基于这种现实的紧迫性,最高人民法院于2009年12月8日印发了《关于人民法院接受新闻媒体舆论监督的若干规定》,对法院主动要求公开和接受新闻监督做了一个积极的表态,也给今后新闻立法时设置相应的规制性条款提供了可借鉴的内容。本文主要以有代表性的具体鲜活案例引出问题,运用比较分析方法、实证分析方法、辩证分析方法等研究方法,直面实践中传媒和司法冲突不断的现状,分析问题,探讨解决问题的方法。从传统媒介和新兴网络类媒介不同的监督方式,几近相同的监督困境,揭示新闻监督司法的现状。分析《关于人民法院接受新闻媒体舆论监督的若干规定》对司法审判权的新闻监督的影响,综合新闻学和司法的视角,揭示第四种权力的重要性及其法律属性,说明新闻监督对司法审判的重要意义。最后,从操作层面和具体监督程序的设计角度,初讨新闻监督应遵循的基本原则以及增强监督的合力和实效的方法,以期达到共赢局面,共同推进社会主义法治建设。
[Abstract]:The relationship between judicial independence, including judicial independence, and social supervision based on news supervision, that is, the relationship between the judiciary and the media, is an important and sensitive issue in the process of socialist legalization construction.The debate on the relationship between the two has a long history and never stops.On the one hand, the fierce debate reveals the details of the two conflicts, on the other hand, it also leads the public to think deeply about reconciling the two relations.Every thing has its dual character, there are conflicts and mutual assistance between judicial independence and news supervision. News supervision not only promotes the fair administration of justice, but also impinges on the independence of the judiciary, especially the independence of the trial.Trial independence requires a relatively closed, as far as possible to eliminate the external environment and factors interference space, it is natural to the supervision of the news will have rejection of the psychology.Therefore, how to delimit the limits of exercise of the two rights and construct the balance point between them is a practical problem that needs to be solved in judicial practice.And because of the urgency of this reality,On December 8, 2009, the Supreme people's Court issued several provisions on the people's Court's acceptance of supervision by public opinion in the news media, which made a positive statement on the court's initiative to request publicity and accept news supervision.It also provides reference for the establishment of corresponding regulation clauses in news legislation in the future.This article mainly uses the representative concrete fresh case to raise the question, uses the comparative analysis method, the demonstration analysis method, the dialectical analysis method and so on research method, faces the media and the judicial conflict unceasingly in the practice present situation, analyzes the question.Explore the solution to the problem.From the traditional media and the new network media different supervision ways, almost the same supervision dilemma, to reveal the current situation of news supervision and justice.This paper analyzes the influence of the regulations on the acceptance of supervision by public opinion in the people's courts on the supervision of the judicial jurisdiction, synthesizes the perspectives of journalism and justice, and reveals the importance and legal attributes of the fourth kind of power.Explain the important significance of news supervision to judicial trial.Finally, from the aspect of operation and the design of concrete supervision procedure, this paper discusses the basic principles that should be followed by news supervision and the methods of strengthening the resultant force and actual effect of supervision, in order to achieve a win-win situation and jointly advance the construction of socialist rule of law.
