检察机关职务犯罪侦查适度公开制度研究

【摘要】：建立有关侦查适度公开的长效机制——检察机关职务犯罪侦查公开制度,是我国预防和打击职务犯罪、保障人权的现实需要。本文从职务犯罪的概念入手分析了职务犯罪的主要现实表现及其主要特征性问题,进而对职务犯罪的有关问题进行了阐述,并以此为基础,阐述了职务犯罪侦查公开与检务公开的关系,还具体分析了职务犯罪适度公开的可能性和现实性。本文从理论角度加强了对检察机关职务犯罪侦查适度公开的阐述,对秩序、自由和人权与职务犯罪侦查进行了关联阐述,始终把侦查公开与秩序、自由和人权统一起来进行论述；从现实角度加强了对我国检察机关职务犯罪侦查公开现状的叙述和评析,叙述了我国检察机关在职务犯罪侦查公开立法、司法方面的现状,叙述了我国检察机关职务犯罪侦查适度公开制度缺失的历史原因和现实问题,主要涉及到保障人权、制约社会经济发展、滋生腐败和浪费司法资源等。这样就使我们更加清楚的认识到,我国检察机关在职务犯罪侦查公开方面存在的不足和缺陷,哪些是制度层面的因素,哪些是客观条件的限制,哪些是人为因素,需要我们从哪些方面做出的努力。针对这些问题,本文最后提出了如何建立检察机关职务犯罪侦查适度公开制度,怎样建立和建立怎么样的侦查适度公开模式,具体对侦查适度公开的基本原则、公开的范围、公开的对象、公开的程度、公开的时限把握等进行了阐述,还对检察机关的侦查一体化制度、有关庭审公开制度进行了必要的叙述和分析,以及对侦查延伸环节的相关规定进行叙述和阐述,并就其他相关问题提出了自己的意见和看法。
[Abstract]:It is necessary to establish a long-term mechanism of proper publicity of investigation, that is, the open system of investigation of duty crimes in procuratorial organs, which is necessary to prevent and crack down on duty crimes and to protect human rights in our country.This paper starts with the concept of duty crime and analyzes its main realistic manifestation and its main characteristic problems, and then expounds the related problems of duty crime, and on this basis,This paper expounds the relationship between the open investigation of duty crime and the openness of procuratorial affairs, and analyzes the possibility and reality of proper publicity of duty crime.From the theoretical point of view, this paper has strengthened the elaboration of the proper openness of the investigation of the procuratorial organ's duty crime, has carried on the correlation elaboration to the order, the freedom and the human rights and the duty crime investigation, has always put the investigation open and the order,This paper discusses the unity of freedom and human rights, strengthens the narration and analysis of the present situation of the investigation and publicity of the duty crimes committed by the procuratorial organs in our country from a realistic point of view, and narrates the present situation of the procuratorial organs of our country in the legislation and the judicature of the investigation of duty crimes.This paper describes the historical reasons and practical problems of the lack of proper publicity system for the investigation of duty crimes committed by procuratorial organs in China, which mainly involves the protection of human rights, the restriction of social and economic development, the breeding of corruption and the waste of judicial resources, and so on.In this way, we will have a clearer understanding of the shortcomings and shortcomings of our procuratorial organs in the publicity of investigation of job-related crimes, which are institutional factors, which are the restrictions of objective conditions, and which are human factors.What efforts should we make?In view of these problems, this paper finally puts forward how to establish the system of proper openness of investigation of duty crime in procuratorial organs, how to establish and establish what kind of appropriate open mode of investigation, the basic principle of proper openness of investigation, and the scope of openness.The public object, the degree of openness, the time limit of the disclosure are expounded, and the necessary narration and analysis of the system of investigation integration of the procuratorial organ and the system of opening trial trial are also carried out.And related provisions of the extended link of investigation are described and expounded, and their own opinions and opinions on other related issues are put forward.
