【摘要】：城镇化作为人类现代文明的重要载体,在促进生产力发展,推动人类文明进程中起着十分重要的作用。建国以来,城镇化建设一直是我国中央经济工作的重点,在城镇化建设取得一定成绩的同时,也引发了一系列的问题,阻碍了经济社会的进一步发展。为了提高城镇化建设的质量,党的十八大提出走新型城镇化道路,以新型城镇化与农业现代化相结合,建设美丽中国。新型城镇化建设已经成为目前研究的热点问题。新型城镇化是新农村建设的重要内容,”三农”问题长期以来都是农村建设的重点和难点问题,而且“三农”问题很多时候又是以涉农纠纷的形式表现出来的。随着新型城镇化建设的推进,农村的社会结构和经济结构转型加快,矛盾和纠纷的数量也迅速上升。涉农纠纷越来越复杂,而现有解决纠纷机制还存在一定缺陷,无法适应新时期的纠纷化解需求。城镇化建设的好坏影响整个农村经济和社会发展,也影响国家的长治久安与整个社会的和谐。建立健全一种适合我国国情的、合理的纠纷化解机制,必须作为一项长期坚持的任务。本研究主要围绕我国新型城镇化建设视角下的涉农纠纷化解机制问题展开研究的,文章在对研究目的与意义、国内外文献综述、研究难点与创新处进行梳理的基础上,首先,对新型城镇化建设和涉农纠纷化解机制的基本理论进行分析,探讨新型城镇化建设与涉农纠纷化解机制的关系,以法学、社会学等理论为支撑,透析新型城镇化建设视角下的涉农纠纷化解机制研究的理论根源。其次,通过城镇化建设过程中涉农纠纷的实证考察,了解涉农纠纷与涉农纠纷化解的基本情况,归纳出新型城镇化建设过程中涉农纠纷的类型与成因,研究新型城镇化建设过程中涉农纠纷化解机制的现状,并对相关问题进行分析,为新型城镇化建设过程中涉农纠纷化解方式的选择提供考量依据。再次,通过对国外典型的国家的涉农纠纷化解机制的考察,总结国外涉农纠纷化解机制对我国的启示,探索新型城镇化建设视角下涉农纠纷化解之道。最后,从新型城镇化建设过程中涉农纠纷化解机制的基础理念、基本原则、具体制度等方面着手,有针对性的建立健全涉农纠纷化解机制,完善该机制能有效运行的相关保障措施,以期促进涉农纠纷化解机制在新型城镇化建设过程中可持续发展,高效解决社会矛盾,维护农村稳定,推动农村发展,保障人民安居乐业,国家的长治久安。
[Abstract]:Urbanization, as an important carrier of human modern civilization, plays an important role in promoting the development of productive forces and the process of human civilization. Since the founding of the people's Republic of China, the construction of urbanization has been the focus of the central economic work of our country. While the construction of urbanization has made certain achievements, it has also caused a series of problems, which has hindered the further development of economic society. In order to improve the quality of urbanization construction, the 18th National Congress of the Communist Party of China proposed to take a new urbanization road, combine new urbanization with agricultural modernization, and build a beautiful China. The construction of new-type urbanization has become a hot issue in current research. New urbanization is an important part of the construction of new countryside. The "three rural" problems have long been the key and difficult problems in rural construction, and the "three rural" problems are often expressed in the form of agriculture-related disputes. With the development of new urbanization, the transformation of social structure and economic structure in rural areas has been accelerated, and the number of contradictions and disputes has risen rapidly. Agricultural disputes are becoming more and more complex, but the existing dispute resolution mechanism still has some defects, which can not meet the needs of dispute resolution in the new era. The construction of urbanization affects the whole rural economy and social development as well as the harmony between the country and the whole society. The establishment and perfection of a reasonable dispute resolution mechanism suitable for China's national conditions must be regarded as a long-term task. This research mainly focuses on the research on the resolution mechanism of agricultural disputes from the perspective of new urbanization construction in China. Based on the research purpose and significance, literature review at home and abroad, research difficulties and innovation, first of all, This paper analyzes the basic theories of the new urbanization construction and the resolution mechanism of disputes involving agriculture, and probes into the relationship between the construction of new urbanization and the resolution mechanism of disputes involving agriculture, which is supported by the theories of law, sociology, etc. This paper analyzes the theoretical roots of the research on the resolution mechanism of agricultural disputes from the perspective of new urbanization construction. Secondly, through the empirical investigation of the agriculture-related disputes in the process of urbanization construction, the basic situation of the agriculture-related disputes and the resolution of the agriculture-related disputes are understood, and the types and causes of the agriculture-related disputes in the process of the new-type urbanization construction are summarized. This paper studies the present situation of the resolution mechanism of the agricultural disputes in the process of the new urbanization construction, and analyzes the related problems, which provides the basis for the selection of the ways to resolve the agricultural disputes in the process of the new urbanization construction. Thirdly, through the investigation of the agricultural dispute resolution mechanism of the typical foreign countries, this paper summarizes the enlightenment of the foreign agricultural dispute resolution mechanism to our country, and explores the ways to resolve the agricultural disputes from the perspective of the new urbanization construction. Finally, from the basic ideas, basic principles, specific systems and other aspects of the mechanism of resolving disputes involving agriculture in the process of new urbanization construction, we should establish and improve the mechanism of resolving disputes concerning agriculture. Perfecting the relevant safeguard measures which can operate effectively in order to promote the sustainable development of the agricultural dispute resolution mechanism in the process of new urbanization construction, to efficiently solve the social contradictions, to maintain the rural stability, and to promote the rural development. To ensure that the people live and work in peace and contentment, and that the country remains stable for a long time.
