论申诉专员的分野

【摘要】:公域申诉专员起源于瑞典,因其优越性而扩展到全世界。由于公域申诉专员的广泛影响,一些私人部门也开始引入申诉专员,作为纠纷解决的一种方式用于处理来自客户的投诉。公域申诉专员与私域申诉专员在以下五个方面具有显著的区分:法律属性,管辖范围,服务的范围,设立的法基础、批准和任命机关,做出建议或决定的拘束力。应当以申诉专员为突破口,发展各种申诉专员,践行事先预防与事后救济一体的理念,提供高效、便捷的权利救济方式,以实现中国的"良法+善治"。
[Abstract]:The Public domain Ombudsman originated in Sweden and expanded to the world because of its superiority. As a result of the widespread influence of the Public area Ombudsman, some private sectors have also introduced the Ombudsman as a way of resolving disputes to deal with complaints from clients. There are significant differences between the Public Ombudsman and the Private Ombudsman in the following five aspects: legal attributes, jurisdiction, scope of service, legal basis, approval and appointment of agencies, and binding power to make recommendations or decisions. We should take the Ombudsman as a breakthrough, develop all kinds of ombudsmen, practice the idea of integrating pre-prevention and post-relief, and provide an efficient and convenient way of right relief so as to realize "good law and good governance" in China.
