王符的司法思想

【摘要】：王符作为一个有强烈社会责任感的思想家十分关注现实问题,也非常关注政治法律问题,对司法问题进行了全面思考。他从"天人合策"的角度论证了司法的形而上根据"天道",认为用司法手段对犯罪的惩治不仅是恢复受损的人间秩序,同时也是恢复受损的自然秩序。他认为,司法的作用在于除暴安良、"劝善消恶",司法的最高目标在于"致太平"。虽然他认为治乱世可用重刑,但仍将司法定位于辅助德化,即所谓"尊德礼而卑刑罚"。他认为,司法官员应当具有谨慎、正直、清廉的品质,做到"平赏罚而无阿私",追求"政平讼治"的境界,通过司法公正树立司法权威、促成社会和谐。
[Abstract]:As a thinker with a strong sense of social responsibility, Wang Fu paid great attention to practical problems and political and legal issues, and gave comprehensive consideration to judicial issues. He demonstrated the metaphysical basis of justice from the angle of "heaven and man combined strategy", and thought that the punishment of crime by judicial means is not only to restore the damaged human order, but also to restore the damaged natural order. In his opinion, the function of justice is to eliminate violence and peace, and the supreme goal of justice is to bring peace. Although he thought that severe punishment could be used in the period of disorder, he still positioned the judicature as auxiliary virtue, that is, "respecting morality and inferiority". In his opinion, judicial officials should have the qualities of prudence, integrity and integrity, achieve "equal rewards and punishments but no private", pursue the realm of "political equality and administration of litigation", establish judicial authority through judicial justice, and promote social harmony.
