破产法视野下中国法院职能研究

【摘要】：法院的职能包括法院的职权和功能。根据《宪法》及《法院组织法》的规定,中国法院的首要职能是行使审判权,对具体争议案件进行判断。随着社会迅速发展,社会矛盾变得多样化和复杂化,频繁发生的社会越轨行为影响社会秩序的稳定和中国社会经济的发展,在此背景下,多个利益集团的诉求和各种社会矛盾持续涌入司法渠道,中国法院的职能出现了扩张,在中国司法实践中,法院不仅行使审判权,同时,也行使一定司法解释权、行政管理权及执行权,法院通过行使上述职权,发挥一定的政治职能及经济职能。本文以破产重整程序为例,通过研究法院在破产重整程序中的地位和作用分析法院的政治性职能和经济职能,并探究法院职能扩张的原因和问题,最后对我国法院改革提出若干建议。
[Abstract]:The functions of the court include those of the court. According to the Constitution and the Law on the Organization of the Court, the primary function of the Chinese courts is to exercise judicial power to judge specific contentious cases. With the rapid development of society, social contradictions become diversified and complicated. The frequent occurrence of social deviant behavior affects the stability of social order and the development of China's social economy. The demands of various interest groups and various social contradictions continue to pour into judicial channels. The functions of Chinese courts have expanded. In Chinese judicial practice, the courts not only exercise judicial power, but also exercise certain power of judicial interpretation. Administrative power and executive power, the court through the exercise of these powers, play a certain political and economic functions. Taking the bankruptcy reorganization procedure as an example, this paper analyzes the political and economic functions of the court by studying the position and function of the court in the bankruptcy reorganization procedure, and probes into the reasons and problems of the expansion of the court's function. Finally, some suggestions are put forward for the reform of our court.
