【摘要】：国务院《关于加强法治政府建设的意见》的出台,对依法行政提出了新的要求。实现公平与正义是依法行政的内在要求和终极目标,而公职律师制度无疑为实现这一目标和要求提供了一种良好的思路。司法部自上世纪九十年代在全国范围内开展试点工作至今,我国公职律师制度可以说已粗具雏型、初见成效。一些地方的试点工作颇具特色,并取得了较大的影响,引起了理论界和实务部门的广泛关注,比如：广州、扬州、周村、厦门等地都是其中突出的代表。然而,公职律师制度作为一项还在探索之中的新型法律制度,有许多需要研究解决的问题,迄今为止意见和认识并不统一。本文首先列举了部分实践中和理论界对公职律师概念的阐述,并结合《律师法》的规定对公职律师概念尝试给出定义；二是进一步阐述公职律师的特性,并在此基础上对相近概念进行了比较分析；三是从公职律师运行状况、存在的问题等方面对我国公职律师制度的发展状况进行了比较详细的分析；四是以香港公职律师制度为范本,试图从中寻找经验和可借鉴之处；最后在阐述设立公职律师的基本原则的基础上,提出了设置公职律师制度的具体构想。
[Abstract]:The introduction of the State Council's opinions on strengthening the Construction of the Government ruled by Law puts forward new requirements for administration by law. The realization of fairness and justice is the inherent requirement and ultimate goal of administration by law, and the public lawyer system undoubtedly provides a good way of thinking for the realization of this goal and requirement. Since the Ministry of Justice carried out the pilot work in the whole country in the 1990s, the public lawyer system of our country can be said to have rudimentary form and initial effect. The pilot work in some places has its own characteristics and has gained great influence, which has aroused the extensive attention of the theoretical circles and practical departments, such as Guangzhou, Yangzhou, Zhoucun, Xiamen and so on. However, as a new legal system still under exploration, there are many problems that need to be studied and solved. So far, opinions and understandings are not uniform. In this paper, the author first enumerates the definition of the concept of public lawyer in some practice and theoretical circles, and tries to define the concept of public lawyer in combination with the provisions of the lawyer's Law; second, it further expounds the characteristics of public lawyer. On the basis of this, the author makes a comparative analysis of the similar concepts: thirdly, the author makes a detailed analysis of the development of the public lawyer system in China from the aspects of the running condition and the existing problems of the public lawyer system; Finally, on the basis of expounding the basic principle of establishing public lawyer, the author puts forward the concrete idea of setting up public lawyer system.
