司法裁判执行难及破解之道

【摘要】：司法裁判执行难是人民法院面临的一个老大难问题。司法裁判执行难背后的深层原因是:法官权威的缺失,程序正义被忽视,既判力的弱化,执行权的失控。破解司法裁判执行难,需增强社会和公众的法律信仰,确立司法裁判活动的道德性,确保裁判结果的公正性,确立司法裁判的终局性。
[Abstract]:The difficulty of administration of justice is an old and difficult problem that the people's court faces. The deep reasons behind the difficulty of judicial decision execution are the lack of the judge's authority, the neglect of procedural justice, the weakening of res judicata and the loss of control of execution power. It is necessary to strengthen the legal belief of the society and the public, to establish the morality of the judicial decision, to ensure the justice of the judicial result and to establish the finality of the judicial decision.
