山西省青年律师生存状况调研报告

【摘要】：“律师是指通过国家司法考试,依法取得律师执业证书,接受委托或者指定,为当事人提供法律服务的专业法律工作者。”①本文所指的“青年律师”是指三十五岁以下的处于律师执业生涯初级及中级阶段的职业律师人群,同时也包括了一部分没有律师资格证,但长期从事近似于律师职业工作的法律工作者。律师在我国经济、政治、文化和生活中发挥着重要的作用。在公众眼中,律师的社会地位和收入水平都居于各职业前列,而实际上律师行业存在着严重的收入分配不均,广大青年律师、法律工作者身上存在诸多不可忽视的社会和群体性问题。本文从山西这个中部省份着手,调查研究了300多名青年律师及法律工作者的社会生存状况,探究问题的症结,从而进一步寻求解决方案。我国律师制度恢复重建以来,律师队伍发展迅速,据2010年11月召开的全国律师工作会议数据统计,目前我国律师事务所已经发展到1.7万多家,律师队伍发展到将近20万人。截至2010年9月,山西省在职律师有3300余名,其中新入职律师600余人,占总数的20%。在调查中我们发现,律师的生存状况存在着很大的问题,在社会地位、工资待遇、加班休假、医疗保险等等方面都面临困境。本调研报告试图从完善律师管理体制,加强青年律师职业培训,促进青年律师素质提高,发挥律师协会的自律和保障作用,广泛宣传律师对于民众生活的有益作用等方面来解决以上问题,改善山西省青年律师的生存状况。
[Abstract]:"A lawyer refers to a professional legal worker who has obtained a lawyer's practice certificate through the state's judicial examination and has been entrusted or appointed to provide legal services to the parties." (1) the "young lawyer" referred to in this article refers to a professional lawyer group under thirty-five years of age in the junior and intermediate stage of the lawyer's practice, and also includes A part of lawyers who have no lawyer's qualification but have been engaged in legal profession for a long time.
Lawyers play an important role in the economy, politics, culture and life of our country. In the eyes of the public, the social status and income level of lawyers are in the forefront of all occupations. In fact, there are serious income dispositions in the lawyers' profession. There are many social and group questions that can not be ignored in the majority of young lawyers and legal workers. Starting from the central province of Shanxi, this paper investigates the social existence of more than 300 young lawyers and legal workers, explores the crux of the problem, and further seeks solutions.
Since the restoration and reconstruction of the lawyer system in China, the team of lawyers has developed rapidly. According to the statistics of the National Lawyers' working conference held in November 2010, the law firms in China have developed to more than 1.7 million, and the lawyers have developed to nearly 200 thousand people. As of September 2010, there were more than 3300 lawyers in Shanxi Province, of which more than 600 new lawyers were recruited. The total number of 20%.
In the investigation, we found that there are a lot of problems in the existence of lawyers. They are facing difficulties in social status, salary treatment, overtime vacation, medical insurance and so on. This research report tries to improve the lawyer management system, strengthen the professional training of young lawyers, promote the improvement of the quality of the young lawyers, and give full play to the self-discipline and protection of the lawyers association. Barrier function, widely publicized the beneficial function of lawyers to the public life, and so on, to solve the above problems and improve the survival condition of young lawyers in Shanxi province.
