论人民陪审团制度

【摘要】：司法民主、司法公正是世界各国司法工作追求的共同价值,而陪审制作为集中体现司法民主和司法公正的制度,它的产生和发展经历了漫长的过程。时至今日,陪审制主要分为两种,一种是以英美为代表的陪审团制,另一种是以德法为代表的参审制。我国在借鉴各国司法经验的基础上制定了具有中国特色的人民陪审员制度,而这项制度在长期的实践应用中却没有体现出其在立法层面上所显示出的优越性,存在着诸多弊端。基于这个原因,河南省高级人民法院推出了人民陪审团制度,并已在全省范围内开始试点。这项制度一经推出,就受到了理论界和实务界的广泛关注,得到了很多赞誉之声但也遭到了不少批评和质疑。 本文通过人民陪审团制度与国外陪审制度以及我国人民陪审员制度的对比,在我国现行的法律框架下寻找人民陪审团制度的合法性和必要性的依据。与此同时,文中还对人民陪审团制度的相关细节提出了一些自己的见解,以期这项制度的试点工作能够更加顺利健康的开展。
[Abstract]:Judicial democracy and judicial justice are the common values pursued by the judicial work all over the world. The jury production, which embodies the judicial democracy and the judicial justice system, has experienced a long process. Up to now, jury system is divided into two kinds, one is jury system represented by Britain and America, the other is trial system represented by Germany and France. On the basis of drawing lessons from the judicial experience of other countries, our country has established the people's jury system with Chinese characteristics, but this system has not reflected its superiority in the legislative level in the long-term practice application, and there are many disadvantages. For this reason, Henan Provincial higher people's Court has introduced the people's jury system, and has started a trial throughout the province. As soon as this system is introduced, it has been paid much attention by the theorists and practitioners, and received much praise, but it has also been criticized and questioned. Through the comparison of the people's jury system with the foreign jury system and the people's jury system of our country, this paper tries to find the basis for the legality and necessity of the people's jury system under the current legal framework of our country. At the same time, some opinions on the details of the people's jury system are put forward in order that the pilot work of this system can be carried out more smoothly and healthily.
