论人民陪审员制度之完善

【摘要】：因陪审制度具有保障司法民主与司法公正等价值,故无论是英美法系还是大陆法系国家,均在司法制度中确立了此项制度。在我国,人民陪审员制度是法律规定的一项基本审判制度,也是一条重要的法律原则。人民陪审员制度是民主政治的表现形式,对于防止司法腐败、促进尊重人权、弘扬法律意识,都起着不可替代的作用。但由于种种因素,我国的人民陪审员制度在立法层面与实施层面不可避免的存在着一些缺陷和问题,有待加以完善和解决。本文首先运用规范分析的方法,在对陪审制度的法律价值和社会功能进行理论研究的基础上,采用实证分析方法,通过列举、归纳和比较,重点指出我国人民陪审员制度在立法方面和实施方面存在的问题,并从立法层面与司法实务层面一一提出自己的建议。在立法上,建议在宪法中确立陪审员制度,修改三大诉讼法、人民法院组织法、《关于完善人民陪审员制度的决定》(以下简称为《决定》),制定《人民陪审员法》,建立健全对陪审员的监督相关立法,确立“人民陪审团”制度等立法完善措施,使人民陪审员制度获得强而有力的立法支撑和保障；在司法实践方面,通过提高人民陪审员的综合素质,完善选用人民陪审员机制,优化人民陪审员的经费保障机制,建立健全对陪审员的管理机制并加强对人民陪审员的培训教育等措施,确保人民陪审员制度实施到位,最终实现其应有的社会功能与法律价值。
[Abstract]:Because the jury system has the value of safeguarding judicial democracy and judicial justice, both Anglo-American and continental law countries have established this system in the judicial system. In our country, the people's jury system is a basic trial system stipulated by law and an important legal principle. The people's jury system is the manifestation of democratic politics, which plays an irreplaceable role in preventing judicial corruption, promoting respect for human rights and promoting legal consciousness. However, due to various factors, the people's jury system in our country in the legislative level and the implementation of the inevitable existence of some defects and problems, to be improved and resolved. Based on the theoretical research on the legal value and social function of the jury system, this paper first uses the normative analysis method to analyze the legal value and the social function of the jury system, through enumerating, summarizing and comparing the legal value and the social function of the jury system. This paper mainly points out the problems existing in the legislation and implementation of the people's jury system in China, and puts forward its own suggestions from the legislative level and the judicial practice level. In terms of legislation, it is proposed to establish the juror system in the Constitution and to amend the three major procedural laws. The Organic Law of the people's Court, the decision on the perfection of the people's jury system (hereinafter referred to as the decision), the formulation of the people's jury Law, the establishment and improvement of relevant legislation on the supervision of jurors, and the establishment of the system of "people's jury", etc. In judicial practice, we should improve the comprehensive quality of the people's jurors, improve the mechanism for selecting people's jurors, and optimize the funding guarantee mechanism for the people's jurors. To establish and improve the management mechanism of jurors and strengthen the training and education of people's jurors, to ensure the implementation of the people's jury system in place, and finally to achieve its due social function and legal value.
