社会主义市场经济需要建立现代企业法律事务制度

【摘要】：正社会主义市场经济就是法治经济改革开放以来,我国从自己的实践出发,大胆借鉴发达国家市场经济法制建设的有益经验,进行了大量的立法工作,先后修改了宪法,制定了260多个法律和有关法律的决定,修改并制定了数以千计的行政法规和部门规章,其中大部分是规范市场经济的。在民商法方面,过去就制定了民法通则,反映了市场经济规律的要求,体现了私法自治的原则,现在又制定了公司法、海商法,并且即将制定保险法、票据法、证卷法等,为市场经济的发展提供基本的法律制度。在经济法方面,先后制定了反不正当竞争法、消费者权益保护法、产品质量法、广告法,正在制定反垄断法,以创造良好的竞争环境,维护市场的公平竞争秩序;另外还制定了预算法、审计法、会计法、税收征管法、个人所得税法、土地管理法、中国人民银行法等,正在制定国有资产法,以增强国家依法对经济实行宏观调控的能力。在社会立法方面,制定了劳动法、工会法、残疾人保护法、妇女权益保护法,即将制定社会保险法、社会救济法等,以建立一个新的社会保障体系,为市场经济创造一个良好的社会环境。一个符合中国国情、反映市场经济规律,与世界相通的社会主义市场经济的法律体系,正在我国迅速成长、完善,到本世纪未可以基本建立起来。
[Abstract]:Since the reform and opening up of the legal economy, China has carried out a lot of legislative work from its own practice and boldly drawing on the beneficial experience of the legal construction of the market economy in developed countries. The Constitution has been amended successively, more than 260 laws and decisions on related laws have been formulated, and thousands of administrative regulations and departmental regulations have been revised and formulated, most of which regulate the market economy, and in the area of civil and commercial law. In the past, the general principles of civil law have been formulated, reflecting the requirements of the law of market economy and the principle of autonomy of private law. Now, we have formulated the company law, maritime law, and will soon formulate insurance law, negotiable instrument law, document law and so on. In terms of economic law, we have successively formulated anti-unfair competition law, consumer rights and interests protection law, product quality law, advertising law and anti-monopoly law. In order to create a good competitive environment and maintain the fair competition order of the market; In addition, a budget law, an audit law, an accounting law, a tax collection and management law, a personal income tax law, a land management law, and a law on the people's Bank of China are also being formulated. In order to enhance the ability of the state to carry out macroeconomic regulation and control of the economy according to law, the labor law, the trade union law, the disabled protection law, the law on women's rights and interests, and the law on social insurance have been formulated in the area of social legislation. In order to establish a new social security system and create a good social environment for the market economy, the law of social relief is in line with China's national conditions and reflects the laws of the market economy. The legal system of socialist market economy, which is connected with the world, is growing rapidly and being perfected in our country, and can not be basically established by this century.
