论弹性化背景下的用工自由与就业安全——从《劳动合同法》的修改争议说起

【摘要】：近年来关于《中华人民共和劳动合同法》(以下简称《劳动合同法》)修改的争论此起彼伏,其焦点在于如何平衡用工自由与就业安全。这场争论的深层背景是全球劳动弹性化浪潮。在弹性化之挑战下,我国劳动法必须处理好公平与效率、弹性与安全、管制与放松管制的关系,兼顾劳动者和用人单位的正当权益。应坚持非典型劳动规范化的基本弹性化模式,挖掘典型劳动内部的弹性潜能,实现二者的法律管制协调及良性转换。应探索出一条通往安全弹性化的理想路径。
[Abstract]:In recent years, there have been arguments over the amendment of the people's Republic of China Labor contract Law (hereinafter referred to as "Labor contract Law"). The focus is on how to balance employment freedom and employment safety. The deep background of this debate is the global labor elasticity wave. Under the challenge of elasticity, China's labor law must deal with fairness and efficiency, flexibility and safety. The relationship between regulation and deregulation, taking into account the legitimate rights and interests of workers and employers, should adhere to the basic elastic mode of standardization of atypical labor and tap the elastic potential within typical labor. In order to realize the coordination and benign transformation of the two laws, we should explore an ideal path to the flexibility of safety.
