论交通事故损害赔偿中被挂靠单位的责任承担

【摘要】:车辆挂靠经营作为运输行业中的一种经营模式在我国普遍存在,然而至今我国相关法律如《道路交通安全法》、《侵权责任法》等仍没有对车辆挂靠经营的法律地位、被挂靠单位的义务、被挂靠单位在挂靠车辆发生交通事故损害赔偿中的责任及承担方式等问题进行明确规定,各地出台的针对处理挂靠经营责任问题的规范性文件中所采取的归责原则不一,法院对于实践中出现的问题在判决时缺乏统一依据,导致各地的判决也不尽相同。本文从现实生活中实际发生的案例出发,对车辆挂靠经营的特征,车辆挂靠经营中涉及的法律关系,发生交通事故时责任的承担主体,承担责任原则等相关法律问题进行了探讨,最后提出被挂靠单位承担的责任类型应确定为“有限的补充赔偿责任”,以期对实务中解决挂靠车辆发生交通事故损害赔偿时被挂靠单位的责任承担问题有所启示。 本文的写作分为以下几个部分进行: 一、从一起交通肇事案出发,提出案件的争议焦点,引出本文主要探讨的是在涉及车辆挂靠关系中,当挂靠车辆发生交通事故损害赔偿时,被挂靠单位是否应承担责任及其承担责任的方式是什么问题。 二、介绍车辆挂靠的含义、特征,分析挂靠人是挂靠车辆的实际所有人,被挂靠单位只是名义所有人,双方之间的权利义务由车辆挂靠协议来约定;挂靠人与被挂靠单位之间是挂靠合同关系,挂靠人雇佣的人与被挂靠单位之间不存在雇佣劳动关系。 三、分析挂靠协议的法律效力,认为法律并无明文规定禁止车辆挂靠经营的行为,因此挂靠行为并不违反法律的规定,车辆挂靠协议只要是符合《合同法》的规定就应该认定是有效的。 四、分析现行立法中关于责任承担主体的相关规定及“运行支配及运行利益”理论,认为被挂靠单位应成为交通事故赔偿责任主体。 五、分析学界中关于挂靠车辆发生交通事故后被挂靠单位承担连带责任、有限连带责任、垫付责任和补充责任的几种学说,提出被挂靠单位应承担有限补充责任的观点。
[Abstract]:As a kind of management mode in the transportation industry, the vehicle link operation exists generally in our country. However, the relevant laws of our country, such as the Road Traffic Safety Law, the Tort liability Law, etc., still have no legal status on the vehicle link operation, so far, the related laws, such as the Road Traffic Safety Law, the Tort liability Law, etc. The obligations of the affiliated unit, the liability and the way to assume the liability of the affiliated unit in the compensation for traffic accident damage caused by the linked vehicle are clearly stipulated. The principles of imputation adopted in the normative documents issued by various localities to deal with the issue of related business liability are different, and the courts lack a unified basis for the problems that arise in practice when adjudicating. This article starts from the actual cases in real life, discusses the characteristics of the vehicle link management, the legal relationship involved in the vehicle link operation, the main body of responsibility in the event of traffic accident. Some related legal issues, such as the principle of liability, are discussed. Finally, the author puts forward that the type of liability should be defined as "limited supplementary liability", in order to solve the problem of liability bearing by the affiliated unit in practice in order to solve the problem of compensation for traffic accident damage caused by the linked vehicle. The writing of this paper is divided into the following parts:. First, starting from a traffic accident case, putting forward the dispute focus of the case, leading to the main discussion in this paper is that in the relation of vehicle connection, when the traffic accident damage compensation occurs on the link vehicle, What is the question of whether the affiliated unit should assume responsibility and how it should be held responsible. Second, introduce the meaning and characteristics of the vehicle link, analyze that the link person is the actual owner of the linked vehicle, the linked unit is only the nominal owner, and the rights and obligations between the two sides are agreed by the vehicle link agreement; The relationship between the affiliated persons and the affiliated units is the contract relationship, and there is no wage labor relationship between the persons employed by the affiliated persons and the affiliated units. Third, analyzing the legal effect of the link agreement, and holding that the law does not explicitly prohibit the operation of the vehicle link, therefore, the act of linking does not violate the provisions of the law. A vehicle alignment agreement shall be deemed valid as long as it complies with the provisions of the contract Law. Fourthly, it analyzes the relevant provisions of the current legislation on the subject of liability and the theory of "operation dominating and operating benefit", and thinks that the affiliated unit should become the subject of liability for traffic accident compensation. Fifthly, this paper analyzes several theories in academic circles about the joint liability, limited joint liability, advanced liability and supplementary liability of the linked unit after the traffic accident, and puts forward the view that the affiliated unit should bear the limited supplementary liability.
