法律语篇英译中衔接的明晰化

【摘要】：随着全球化进程的加深,法律翻译作为国家间法律交流的重要媒介受到越来越多的重视,并逐渐成为特殊语言研究的重点之一。目前,中国法律翻译虽数量庞大,但质量良荞不齐。因此,探究法律翻译理论与实践并对中国法律英译本的分析可以进一步促进国内法律翻译的进步,同时也可以促进中西方法律文化交流。严谨准确是法律翻译的最大特点,这就要求译者在翻译的过程中将原文信息最充分地展示给读者,以免造成语义模糊。衔接是构成文本连贯的重要因素之一,其翻译是否准确直接影响翻译质量。中英衔接方式存在较大差异,如何应对这种差异并满足法律翻译严谨准确的要求,是译者需要在翻译过程中解决的棘手问题。明晰化翻译是翻译共性理论的研究热门领域之一,受到了越来越多的国内外翻译学者的重视。明晰化是指,为了避免译文因语言差异造成语法语义错误,及读者因文化差异造成理解错误,有意或无意的将原文中隐含的信息明晰化的过程,使译文更自然,更具有可读性。本文尝试建立汉英平行语料库,对中国两大权威法律出版社出版的《中华人民共和国劳动合同法》和《中华人民共和国合同法》中衔接手段进行分析,以了解法律语篇英译中衔接的显化现象,并期待证明中国法律文本英译中衔接确有显化的假设。
[Abstract]:With the deepening of globalization, legal translation has attracted more and more attention as an important medium for legal exchanges between countries, and has gradually become one of the focal points in the study of special languages. Therefore, exploring the theory and practice of legal translation and analyzing the English translation of Chinese laws can further promote the progress of domestic legal translation, and also promote the exchange of legal culture between China and the West. Rigorous and accurate translation is the most important feature of legal translation, which requires the translator to display the original information to the reader in the process of translation to avoid semantic ambiguity. Cohesion is one of the important factors of text coherence. Whether the translation is accurate or not has a direct impact on the quality of translation. There are great differences in Chinese and English cohesion. How to deal with this difference and meet the strict and accurate requirements of legal translation is a thorny problem that the translator needs to solve in the process of translation. Clarity translation is one of the hot research fields of translation generality theory, which has been paid more and more attention to by more and more translators at home and abroad. Due to the cultural differences, the readers make the process of clarifying the implied information in the original text, which makes the translation more natural and readable. This paper attempts to establish a parallel corpus of Chinese and English, and analyzes the cohesive devices in the Labor contract Law of the people's Republic of China and the contract Law of the people's Republic of China, published by two authoritative law publishers in China. In order to understand the explicit phenomenon of cohesion in English translation of legal texts, we hope to prove the hypothesis of explicit cohesion in English translation of Chinese legal texts.
