威利斯顿法学理论的教育价值

【摘要】：英美法系著名学者塞缪尔.威利斯顿对美国法律学术及法律教育的影响是深远的。威利斯顿起草了多部法典,为三十几个州所用。他是第一次《合同法重述》的起草负责人及报告人,撰写了《合同法》,被视为年轻法律人士的书面向导。本文通过对塞缪尔.威利斯顿学术理论体系的借鉴,通过对其法律理论实用性价值的剖析,以及对其学术理论所产生的不同看法的考量,来阐明其理论实用性价值及规范性引导对法律教育的重要作用。
[Abstract]:Samuel, a famous scholar in Anglo-American law system. Williston's influence on the American legal academic and legal education is profound. Williston drafted several codes for use in more than thirty states. He was the draftsman and presenter of the first restatement of contract Law, and was regarded as a written guide for young lawyers. This paper deals with Samuel. By analyzing the practical value of Williston's academic theory system, and considering the different views produced by his academic theory, To clarify its theoretical practical value and normative guidance of the important role of legal education.
