【摘要】：农民工是伴随着我国改革开放和城镇化、工业化进程涌现出的劳动力大军,是指那些具有农村户籍身份,以从事非农产业为生的劳动力。他们脱离了在农村的务农生活,游荡在城市里。城市离不开他们,却又歧视、排斥他们；他们付出的劳动多,得到的回报却少。农民工遭遇的不公平待遇与我国的和谐社会理念是背道而驰的,同时也给社会的稳定与发展带来了极大的隐患,引起了社会各界的广泛关注。本文依据民主、自由、平等、人权、理性、文明等法治理念和法学理论,基于对某工业园区制造业农民工的调查研究,分析了制造业农民工的生活、工作、劳动权益保障等方面的现状,总结了制造业农民工具有年轻化、相对较高的文化水平、希望在城市发展等特点,并深入剖析了农民工劳动权益保障方面存在的问题及原因。这些问题主要是：(1)工作时间长、劳动条件差、娱乐少；(2)工资水平偏低；(3)合同签订率较高,但是他们大多数是派遣工,是与派遣公司签的劳动合同；(4)参保率普遍偏低,社会保障机制严重缺失；(5)组织化程度低；(6)人力资本水平低下。造成这些问题的原因有农民工自身文化素质偏低、职业技能差等主观方面的,也有制度不完善、法律不健全以及政府监管不力等客观方面的。针对制造业农民工自身的特点和劳动权益保障方面存在的问题及原因分析,结合我国社会主义国家的社会体制特点和社会现状,文中提出了维护农民工权益的一些对策建议,包括：(1)加快完善和落实覆盖农民工的社会保险制度;(2)加强工会对农民工的维权力度;(3)加大对农民工培训教育力度；(4)重视农民工劳务派遣工权利的维护；(5)加强政府监管,形成保障农民工权益的责任制。制造业农民工是一个年轻的群体,他们是城市产业工人主体力量的一部分,保护他们的劳动权益,就是在保护社会主义建设的生产力；是提高政府执政能力的一个重要方面；是以人权和公平正义为理念的社会主义法治建设的应有之义。
[Abstract]:Migrant workers are accompanied by China's reform and opening up and urbanization, industrialization process emerged in the labor force, refers to those with rural household registration status. The labors who are engaged in non-agricultural industries. They leave the life of farming in the countryside and wander around in the city. The city cannot do without them, but it discriminates against them and excludes them. The unfair treatment encountered by migrant workers runs counter to the concept of a harmonious society in our country, and it also brings great hidden dangers to the stability and development of the society. Has caused the widespread concern of the society from all walks of life. Based on democracy, freedom, equality, human rights, rationality, civilization and other legal theories, this paper analyzes the life and work of manufacturing migrant workers in an industrial park. The current situation of labor rights and interests security, summed up the manufacturing migrant workers with younger, relatively high education level, hoping to develop in the city and other characteristics. It also deeply analyzes the problems and causes of the protection of migrant workers' labor rights and interests. These problems mainly include long working hours, poor working conditions and less entertainment. (2) low wages; (3) the contract signing rate is high, but most of them are dispatch workers, which are labor contracts signed with dispatch company; (4) the participation rate is generally low and the social security mechanism is seriously lacking; (5) low degree of organization; 6) low level of human capital. The causes of these problems are low cultural quality of migrant workers, poor vocational skills and other subjective aspects, but also imperfect system. According to the characteristics of migrant workers in manufacturing industry and the labor rights and interests protection problems and reasons are analyzed. According to the characteristics of the social system and the current social situation of the socialist countries in our country, this paper puts forward some countermeasures and suggestions to safeguard the rights and interests of migrant workers, including: 1) speeding up the improvement and implementation of the social insurance system covering migrant workers; (2) strengthening labor unions' efforts to protect the rights of migrant workers; (3) strengthening the training and education of migrant workers; (4) attach importance to the maintenance of migrant workers' labor dispatch rights; Fifth, strengthen government supervision to form a responsibility system to protect the rights and interests of migrant workers. Manufacturing migrant workers are a young group, they are part of the main force of urban industrial workers, to protect their labor rights and interests, is to protect the productive forces of socialist construction; It is an important aspect of improving the government's ruling ability. Is the concept of human rights and fairness and justice as the concept of socialist construction of the rule of law should be the meaning.
