论我国劳务派遣法律制度的问题与完善

【摘要】:我国劳务派遣制度伴随着经济体制改革的不断深化而发展,兴起于上世纪70年代末期。作为一种非正式的劳动关系,一种新型的就业制度,社会各界对此争论不断,褒贬不一,部分专家学者针对我国劳务派遣制度中产生的诸多问题主张终止这一用工制度。因此,从我国劳务派遣现状出发,全面剖析这一制度所存在的问题及原因,探讨完善我国劳务派遣法律制度具有十分重要的意义。 随着改革开放的不断深化,,公有制为主体时代单一制用工的终结,体制改革后多种用工身份的出现与规范,现代企业制度下人工成本的高度控制,推动了劳务派遣制度在我国的快速发展。劳务派遣制度的出现,为整合就业资源、提高就业效率、节约企业成本、推动经济发展起到了积极作用。但由于我国劳务派遣法律制度不尽完善、法律责任规定不明、行政监管缺位等原因,造成我国劳务派遣在其过度发展中暴露了诸多问题,如派遣用工长期使用、滥加使用现象严重,同工不同酬、社会保障待遇不平等、生产环境相对恶劣等侵害派遣员工权益的问题突出,而一旦出现劳资矛盾则普遍出现解决渠道不畅、纠纷调处困难等问题。要推动我国劳务派遣制度健康有序发展,必须针对我国劳务派遣制度中存在的问题,充分借鉴国外的有益做法,加快完善我国劳务派遣法律制度。要加强劳务派遣法律制度建设,完善劳务派遣法律体系,尽早修改《劳动合同法》,出台专门法律;要合理界定“三性”范围,严格限定派遣领域,明确派遣期限;要建立行政许可制度,加强行政监管,强化资本保证金制度;要明确派遣公司、用工单位、派遣员工三方义务,推动各方共同遵守法律;要严格违法责任追究,合理划分派遣公司与用工单位的连带责任,提高法律的可执行力度;要加强工会组织建设,充分发挥工会作用等。
[Abstract]:The labor dispatch system of our country develops with the deepening of the economic system reform, rising in the end of -30s. As an informal labor relationship, a new type of employment system. Some experts and scholars put forward the idea of terminating the employment system in view of many problems arising from the labor dispatch system in our country. Therefore, starting from the current situation of labor dispatch in China. It is of great significance to analyze the existing problems and reasons of this system and to improve the legal system of labor dispatch in China. With the deepening of reform and opening up, the end of the single system of labor in the era of public ownership as the main body, the emergence and standardization of various employment identities after the system reform, and the high control of labor costs under the modern enterprise system. It promotes the rapid development of labor dispatch system in China and the emergence of labor dispatch system in order to integrate employment resources improve employment efficiency and save the cost of enterprises. The promotion of economic development has played a positive role, but due to the imperfect legal system of labor dispatch, the legal liability is unclear, the absence of administrative supervision and other reasons. As a result, China's labor dispatch has exposed many problems in its excessive development, such as the long-term use of dispatched workers, excessive use of serious phenomenon, equal pay, social security treatment inequality. The problem of violating the rights and interests of dispatch staff is prominent, but once there is labor contradiction, there is generally a lack of channels to solve the problem. In order to promote the healthy and orderly development of China's labor dispatch system, we must fully learn from the beneficial practices of foreign countries in view of the problems existing in our labor dispatch system. It is necessary to strengthen the construction of the legal system of labor dispatch, perfect the legal system of labor dispatch, amend the Labor contract Law as soon as possible, and issue special laws; It is necessary to define the scope of "three characters" reasonably, strictly limit the field of dispatch and define the dispatch period. It is necessary to establish the administrative license system, strengthen the administrative supervision and strengthen the capital deposit system; To clear the dispatch company, employment units, send employees tripartite obligations, to promote the parties to abide by the law; It is necessary to strictly investigate the illegal liability, reasonably divide the joint and several liability between the dispatching company and the employing unit, and improve the enforcement of the law; It is necessary to strengthen the construction of trade union organizations and give full play to the role of trade unions.
