劳动人事争议裁审衔接机制构建的新思考

【摘要】:我国劳动人事争议仲裁和诉讼存在实体和程序上的衔接不畅。要从根本上解决该问题,必须从正确定位劳动仲裁的性质着手,并在此基础上厘清劳动仲裁和诉讼衔接的实质:劳动仲裁和诉讼不是普通仲裁和诉讼的关系,而是劳动人事争议专门机构和普通法院的关系,应将劳动仲裁定位为司法性或准司法性,与此一致,裁审关系是特殊的一审和二审的关系。为此,需要重构劳动人事争议处理审级制度,取消和劳动仲裁性质不相吻合的程序和制度,并赋予劳动仲裁机构保全等强制性权力。
[Abstract]:The substantive and procedural connection between arbitration and litigation of labor and personnel disputes in China is not smooth. In order to solve this problem fundamentally, we must start with the correct orientation of the nature of labor arbitration. And on this basis to clarify the essence of labor arbitration and litigation convergence: Labor arbitration and litigation is not the relationship between ordinary arbitration and litigation, but the relationship between specialized agencies of labor and personnel disputes and ordinary courts. The labor arbitration should be defined as judicial or quasi-judicial. In accordance with this, the adjudication relationship is a special relationship between the first instance and the second instance. Therefore, it is necessary to reconstruct the system of handling labor personnel disputes. Cancel the procedure and system which are inconsistent with the nature of labor arbitration, and endow labor arbitration institution with compulsory power such as preservation.
