我国农民工医疗保险法律制度研究

【摘要】：近年来,随着我国医保制度改革的不断推进和完善,农民工的医保问题越来越引起全社会的普遍重视。解决好农民工的医保问题,是建立覆盖全民的多层次医保体系的重中之重。它是坚持和落实以人为本的科学发展观,实现经济社会全面、协调、可持续发展的迫切需要,同样是全面建设小康社会,促进社会和谐的必然要求。在实践过程中,我国的医保制度并未给农民工带来等同于城镇居民的便利,为了使农民工真正受益于我国的医疗保险服务,应享有的医疗保险权利得以真正实现,借助法律这个强有力的支持是十分必要的。当前,随着相关法律法规的不断构建与完善,全国各地尤其是农民工较集中的区域,陆续发布了有关农民工医疗保险的实施规范,使农民工医保政策的约束力从义务上升为责任。所以,深入研究我国农民工医疗保险法律制度的相关问题,不但有助于农民工医疗平等权的实现,有利于我国和谐社会的保障,而且对促进我国经济发展具有深远的影响。文章由五个部分构成,第一部分介绍了农民工医疗保险的选题背景和研究意义,简述该问题的国内外研究现状,并提出文章的研究方法。第二部分系统阐述农民工医疗保险法律制度,首先简单阐述了农民工医疗保险法律制度的相关定义;其次简述其特征;再次,指出其作用。第三部分从我国农民工医疗保险法律制度的现状出发,分别由农民工医疗保险法律制度的初创阶段、发展阶段、重点转移阶段等角度阐述了其立法进程,接着简述了农民工医疗保险法律制度的模式探索。第四部分在前文的基础上,陈述了我国农民工医疗保险法律制度的缺陷及产生缺陷的原因,缺陷分别是农民工医疗保险制度立法滞后、农民工医疗保险法律监督与实施机制薄弱,以及农民工基本医疗保险权转移接续困难。产生缺陷的原因有我国城乡二元结构的阻碍和我国农民工医疗保险法治不完善。最后,依次从农民工医疗保险立法、农民工医疗保险基金筹措机制、农民工医疗保险监督与实施机制、农民工基本医疗保险权转移接续的角度,提出构建我国农民工医疗保险法律制度的一些设想,力求能有助于我国农民工社会保险法律制度及其相关配套措施的建立和完善。
[Abstract]:In recent years, with the continuous promotion and improvement of the reform of medical insurance system in China, the medical insurance of migrant workers has attracted more and more attention of the whole society. It is the most important to establish a multi-level medical insurance system covering all the people. It is the urgent need to adhere to and implement the people-oriented scientific development concept and to achieve comprehensive, coordinated and sustainable development of the economy and society. It is also an inevitable requirement to build a well-off society and promote social harmony. In the process of practice, the medical insurance system of our country has not brought migrant workers the same convenience as urban residents. In order to make migrant workers really benefit from the medical insurance service in our country, the right of medical insurance should be truly realized. It is very necessary to use the strong support of the law. With the continuous construction and improvement of relevant laws and regulations, all parts of the country, especially in the areas where migrant workers are more concentrated, have issued the implementation norms of medical insurance for migrant workers one after another. The binding force of medical insurance policy for migrant workers is increased from obligation to responsibility. Therefore, in-depth study of the legal system of medical insurance for migrant workers in China is not only conducive to the realization of the equal right of migrant workers to medical care. The article is composed of five parts. The first part introduces the background and significance of the topic selection of medical insurance for migrant workers. The second part systematically expounds the legal system of medical insurance for migrant workers. First, it simply expounds the definition of the legal system of medical insurance for migrant workers. Secondly, its characteristics are briefly described. Thirdly, it points out its function. The third part starts from the current situation of the legal system of medical insurance for migrant workers in China, respectively from the initial stage of the legal system of medical insurance for migrant workers, the stage of development. From the point of view of the shift stage, the author expounds the legislative process, and then expounds the exploration of the legal system of medical insurance for migrant workers. Part 4th is based on the above. The defects of the legal system of medical insurance for migrant workers in China and the reasons for the defects are described. The defects are the lagging legislation of the medical insurance system of migrant workers and the weak legal supervision and implementation mechanism of the medical insurance of migrant workers. And the transfer of migrant workers' basic medical insurance rights is difficult. The reasons for the defects are the hindrance of urban-rural dual structure and the imperfect rule of law of migrant workers' medical insurance. Finally, from the migrant workers medical insurance legislation in turn. The mechanism of raising medical insurance fund for migrant workers, the supervision and implementation mechanism of medical insurance for migrant workers, and the transfer of the right to basic medical insurance of migrant workers are put forward, and some tentative ideas of constructing the legal system of medical insurance for migrant workers in China are put forward. It is helpful to establish and perfect the legal system of social insurance for migrant workers in China.
