国际贸易中的劳工标准问题之法律分析

【摘要】：国际贸易中的劳工标准问题,一直是发达国家与发展中国家争论的焦点。发达国家积极主张将劳工标准直接与国际贸易挂钩,以削弱发展中国家在劳动密集型产业上的优势,发展中国家则反对以贸易制裁的手段推动劳工标准的实施。自由贸易与劳动世界的进步及社会的全面发展都是人类所追求的目标,然而利用贸易制裁的方法促进劳工标准水平的提高却具有不合理性。作为世贸组织成员国和国际劳工组织创始国的中国对劳工标准问题应审慎对待,因为这一问题将长期存在,并有可能成为WTO新一轮谈判的议题。所以,从法律角度研究国际贸易中的劳工标准问题具有十分重要的意义。本文采用理论分析、比较归纳、历史分析、案例考察等方法对此进行了研究。本文除引言和结论外,共分四部分。第一部分为国际贸易中劳工标准问题概述。该部分在对劳工标准的概念、内容进行详细阐述的基础上,对国际贸易中劳工标准问题的由来作了分析。本文认为,劳工标准在一定程度上促进了国际贸易的发展,主要原因是其促进了公平、有序、健康的竞争环境的形成,但劳工标准在国际贸易中也存在某些负面现象,主要是劳工标准松化现象与某些发达国家利用劳工标准形成单边贸易壁垒的现象。发达国家力图使其单边贸易壁垒做法合法化,由此,劳工标准是否应与国际贸易挂钩日益受到关注。第二部分论述国际贸易中劳工标准的法律渊源。对于国际贸易中的劳工标准问题,有关的国际组织文件及国内立法有所涉及,这些有关规定构成了国际贸易中劳工标准问题的法律渊源。主要包括:世贸组织法律体系中的规范,包括《建立WTO的马拉喀什协定》序言及《技术性贸易壁垒协议》目标、GATT1994第20条、《服务贸易总协定》;有关国
[Abstract]:The issue of labor standards in international trade has always been the focus of dispute between developed countries and developing countries. Developed countries actively advocate the direct linking of labor standards with international trade. To weaken the advantage of developing countries in labour-intensive industries. Developing countries oppose the use of trade sanctions to promote the implementation of labour standards. Free trade and the progress of the world of labor and the overall development of society are the goals of human pursuit. However, it is unreasonable to use the method of trade sanctions to improve the level of labor standards. As a member of WTO and a founding member of the International Labour Organization, China should treat the issue of labor standards with caution. Because this problem will exist for a long time, and it is likely to be the subject of a new round of WTO negotiations. It is of great significance to study the issue of labor standards in international trade from the angle of law. This paper studies this problem by means of theoretical analysis, comparative induction, historical analysis, case study and so on. In addition to the introduction and conclusions, this paper is divided into four parts. The first part is an overview of labor standards in international trade, which is based on the detailed elaboration of the concept and content of labor standards. This paper analyzes the origin of labor standards in international trade. This paper holds that labor standards promote the development of international trade to a certain extent, mainly because they promote fairness and order. The formation of a healthy competitive environment, but labor standards in international trade there are some negative phenomena. It is mainly the phenomenon of the loosening of labor standards and the phenomenon that some developed countries use labor standards to form unilateral trade barriers. The developed countries try to legalize their unilateral trade barriers. Whether labour standards should be linked to international trade has received increasing attention. The second part discusses the legal sources of labor standards in international trade. The relevant documents of international organizations and domestic legislation are involved in the issue of labor standards in international trade. These provisions constitute the legal source of the issue of labour standards in international trade, mainly including the norms in the WTO legal system.
