企业劳动规章制度效力研究

【摘要】:企业劳动规章制度系由企业单方制定与变更,在理论和实践层面都不可避免地带来诸多问题。理论上,企业并不是立法主体,其单方制定的规章制度却具有拘束劳动关系相对方的法律效力,其依据何在?实践上,企业因其占有生产资料而处于绝对地优势地位,如何平衡资方与劳方的利益冲突?由处于强势地位的一方制定规则显然不符合公平正义的原则,弱势劳动者的合法权益如何才能得到保障?无疑,这些问题棘手但亟待解决。 除前言和结语外,本文共分四章,主要内容如下: 第一章探讨企业劳动规章制度的效力渊源。本章首先对目前学界几种比较主流的观点进行简单介绍并作精要评析,然后在吸收前述几种观点精华的基础上,主张应区分规章制度条文是否涉及到劳动者切身利益。最后从理论和立法层面详细论证了“二分说”的优越性。通过这一部分的介绍,为接下来有关企业劳动规章制度效力的形式、认定与冲突做铺垫。 第二章研究企业劳动规章制度效力的生效要件。在第一章论述的逻辑起点上,本部分内容由企业劳动规章制度的制定主体、规章内容、制定程序三个方面组成。分别从积极和消极两个维度具体分析企业劳动规章合法所需满足的条件以及违反这些条件所应承担的法律后果。 第三章主要分析企业劳动规章制度的效力形式。本章从契约效力和裁判效力两个角度入手,先分析企业劳动规章制度对契约双方的效力表现以及违反企业劳动规章制度的法律责任,其中着重论述了企业的惩戒权。然后分仲裁机关和司法机关两个不同的主体论述企业劳动规章制度的裁判效力。 第四章分析企业劳动规章制度与劳动合同、集体合同三者之间的效力冲突,并针对每种冲突的情况提出相应的解决办法,以期对实践产生一定的指导作用。
[Abstract]:Enterprise labor rules and regulations are formulated and changed unilaterally by enterprises, which inevitably bring many problems in theory and practice. In theory, enterprises are not the main body of legislation. However, the rules and regulations formulated by its unilateral parties have the legal effect of binding on the relative parties of labor relations. What is the basis for the rules and regulations formulated by them? In practice, the enterprise is in an absolute dominant position because of its possession of the means of production. How to balance the conflict of interests between the management and the labor? It is obviously not in line with the principle of fairness and justice to make rules by the party in a strong position. How can the legitimate rights and interests of vulnerable workers be protected? There is no doubt that these problems are thorny but urgent. In addition to the preface and conclusion, this paper is divided into four chapters, the main contents are as follows: The first chapter discusses the effectiveness of enterprise labor rules and regulations. Firstly, this chapter briefly introduces and comments on some of the main ideas in the academic world, and then on the basis of absorbing the essence of the above several views. The author argues that the rules and regulations should be distinguished from the interests of the laborers. Finally, the advantages of the "dichotomy" are demonstrated in detail from the theoretical and legislative levels. Through the introduction of this part. For the following forms of enterprise labor rules and regulations, the identification and conflict do paving the way. The second chapter studies the effective requirements of the effectiveness of the enterprise labor rules and regulations. In the logical starting point of the first chapter, the content of this part is made by the main body of the enterprise labor rules and regulations, the content of the regulations. From the positive and negative aspects, the author analyzes the legal requirements and the legal consequences of violating these conditions. The third chapter mainly analyzes the effective form of the enterprise labor rules and regulations. This chapter starts from the contract effect and the adjudication effect two angles. First, it analyzes the effectiveness of the enterprise labor rules and regulations on both sides of the contract and the legal liability for violating the enterprise labor rules and regulations. Then it discusses the adjudication effect of enterprise labor rules and regulations by two different subjects: arbitration organ and judicial organ. Chapter 4th analyzes the conflicts between labor rules and regulations, labor contracts and collective contracts, and puts forward corresponding solutions to each conflict, in order to give some guidance to the practice.
