工伤认定举证责任的困境及出路

【摘要】：工伤认定举证责任的分配关系到工伤劳动者权利的保护能否得到实现。《工伤保险条例》规定,职工或者其直系亲属认为是工伤,用人单位不认为是工伤的,由用人单位承担举证责任,即工伤认定实行有利于工伤劳动者的举证责任倒置,但在工伤认定行政诉讼中却发生改变,使得工伤认定中举证责任最终由工伤劳动者承担,立法目的和实际运行发生巨大偏差。从要根本上改变这种状况,必须重构工伤认定程序。
[Abstract]:The distribution of the burden of proof for the identification of work-related injuries is related to whether the protection of the rights of workers at work injury can be realized. According to the regulations on Industrial injury Insurance, workers or their immediate family members are considered to be work-related injuries, and the employer does not consider them to be work-related injuries. The burden of proof is borne by the employer, that is, the burden of proof is reversed in favor of the work-related injury workers in the determination of industrial injury, but the burden of proof is changed in the administrative proceedings for the identification of industrial injury, so that the burden of proof in the identification of industrial injury is ultimately borne by the work-related injury worker. There is a huge deviation between the legislative purpose and the actual operation. In order to fundamentally change this situation, it is necessary to reconstruct the procedure of industrial injury identification.
