用人单位设置劳动报酬支付条件方略

【摘要】:正实践中,用人单位或与劳动者约定,或通过规章制度对劳动者的某些劳动报酬设定一定支付条件的情形较为常见。如用人单位规定员工年终考核合格后才可享受绩效奖,年终奖对次年仍在职的员工发放,销售提成奖按销售款回款的比例或待销售款全额到账后支付,等等。有些用人单位规定将劳动者每月工资的一部分作为"业绩提成"暂不发放,到年底考核时再根据劳动者的工作业绩
