论我国劳动争议仲裁机制的缺陷与完善

【摘要】： 我国劳动争议仲裁制度自80年代恢复以来,其发展已有近20年的历史。随着我国市场经济体制改革的深化,在90年代初期形成的劳动争议仲裁制度存在的缺陷也显现出来。任何一种制度都有一个从产生到完善的过程,我国劳动争议仲裁制度亦是如此,劳动争议仲裁制度改革的呼声也日益高涨。在我国,劳动仲裁制度作为劳动争议机制的重要组成部分,是劳动争议处理程序中的关键环节。因此,劳动仲裁制度的构建合理与否,直接关系到劳动者权利能否得到救济,关系到劳动关系能否和谐发展。本文选择劳动争议处理仲裁制度为研究对象,以改革和完善劳动争议仲裁机制为目标追求,从劳动争议仲裁的性质入手,在分析了我国劳动争议仲裁机制存在的一些问题的基础上,对完善我国劳动争议仲裁法律体系、健全劳动争议仲裁组织制度、重构劳动争议仲裁程序和加强劳动争议仲裁监督等方面提出了一些意见和建议,以期为劳动者提供更为畅通、有效的权利救济渠道。
[Abstract]:China's labor dispute arbitration system has been developed for nearly 20 years since it was restored in the 1980s. The defects of the labor dispute arbitration system formed in the early 1990s also appear. Any system has a process from birth to perfection, and so is the labor dispute arbitration system in our country. In our country, as an important part of labor dispute mechanism, labor arbitration system is a key link in labor dispute settlement procedure. Whether the construction of labor arbitration system is reasonable or not is directly related to the relief of workers' rights and the harmonious development of labor relations. This article chooses the labor dispute handling arbitration system as the research object, takes the reform and the consummation labor dispute arbitration mechanism as the goal pursue, starts from the labor dispute arbitration nature, Based on the analysis of some problems existing in the mechanism of labor dispute arbitration in our country, this paper improves the legal system of labor dispute arbitration and the organization system of labor dispute arbitration in China. This paper puts forward some opinions and suggestions on the reconstruction of labor dispute arbitration procedure and strengthening the supervision of labor dispute arbitration in order to provide workers with a more smooth and effective relief channel for their rights.
