我国社会保险权利救济制度的理论悖论与现实困境——“裕元事件”引发的思考

【摘要】："裕元事件"引发全社会对社保权利救济的关注。劳动者通过罢工这一非法形式寻求社保缴费的合法诉求,暴露出的是社保制度内部"强制补缴"与保险原理之间的深层矛盾。《劳动法》体制下形成的以"公私平衡"为特点的过渡性做法,有效缓解了这一矛盾;《社会保险法》"一大二公"式的改革由于制度本身的悖论与过高的推行成本,有可能激化社会保险制度的内在矛盾。未来我国社会保险权利救济制度需要在重新思考强制性与保险性、国家与地方、公法与私法关系的基础上达成新的平衡。
[Abstract]:The "Yuyuan incident" has aroused the concern of the whole society about the relief of social security rights. Workers seek the legitimate demand for social security payment through the illegal form of strike. What is exposed is the deep contradiction between "compulsory repayments" and the principle of insurance within the social security system. The transitional approach characterized by "public and private balance" is formed under the "Labor Law" system. This contradiction has been effectively alleviated. Due to the paradox of the system itself and the excessively high cost of implementation, the reform of the "big two public" style of the "Social Insurance Law", It is possible to intensify the inherent contradiction of social insurance system. In the future, the relief system of social insurance rights in China needs to reach a new balance on the basis of rethinking the relationship between compulsory and insurance, state and local, public law and private law.
