山西省大学生就业调控法律问题研究

【摘要】: 目前,高校毕业生的就业问题日益成为全社会关注的焦点,并且成为我国当前经济社会发展中的严峻挑战和突出问题,这种状况持续下去将会严重妨碍整个社会的和谐发展。究其原因,就业市场机制不完善,一些体制性障碍的存在,是造成我国教育体制转轨过程中大学生就业难的重要因素。如何发挥政府宏观调控的主导作用,完善就业市场,运用政策和法律手段扫除体制性障碍,以政策引导大学生就业,整体推进大学生充分就业,进而实现整个社会的和谐发展,还需要进行不断的研究和探索,并具有重要的理论和现实意义。 本文以山西省当前高校毕业生的就业现状为立足点,分析了导致大学毕业生就业难的因素,以宏观调控法为核心,综合运用法理学、宪法学、劳动法学及经济学、社会学等学科原理和学者的研究成果,对大学生就业问题加以研究,结合山西省的省情,阐述了宏观调控法调整大学生就业问题的必要性,以期促进山西省大学毕业生的就业工作顺利进行。全文分四个部分。 第一部分,大学生就业与宏观调控的基本理论。本文从大学生就业的基本内涵入手,结合宏观调控法理论的就业调控内容,进一步分析大学生就业与宏观调控理论的相互关系,得出大学生就业只有在国家进行宏观调控的情况下才能得以解决。 第二部分,山西省促进大学生就业的宏观调控政策及法律调整。在本部分,分析了山西省近几年的就业现状与存在的问题,以及山西省促进大学生就业的政策和法律,提出现有的安置大学生就业政策具有临时性和不稳定性,并指出促进大学生就业专门性政策与法律调控体系的建立,是解决大学生就业的根本措施。 第三部分,国内外促进大学生就业的宏观调控政策及法律调整。笔者首先对我国促进大学生就业的宏观调控政策及法律进行了分析。然后对美国、日本和英国三个国家的大学生就业调控政策分别进行了阐述与比较研究。借鉴国外大学生就业促进政策,对比分析我国市场经济过程中解决大学生就业所存在的问题和对策,更有助于理论和政策的科学性与有效性。 第四部分,在前三部分的基础上,笔者认为,加快山西省中小企业的发展,重点扶持知识与科技含量高的产业,增加企业劳动力容纳量;加强山西省重点高校、重点学科专业的建设,提高学生质量和综合素质;加强大学生就业地方立法,加快大学毕业生就业市场的地方法规建设,成立平等就业监督咨询机构,加强内部和外部监督,完善宏观调控体系,为山西省大学生就业提供长效、稳定的制度保障。
[Abstract]:At present, the employment of college graduates has increasingly become the focus of attention of the whole society, and has become a severe challenge and prominent problem in the current economic and social development of our country. The continuation of this situation will seriously hinder the harmonious development of the whole society. The reason is that the mechanism of the job market is not perfect and some institutional obstacles exist. It is an important factor that causes the college students' employment difficulty in the course of the transition of our country's educational system. How to give play to the leading role of the government's macro-control, perfect the job market, use the policy and legal means to remove the system obstacle, and guide the university student's employment by the policy. In order to promote the college students to obtain full employment and realize the harmonious development of the whole society, it is necessary to study and explore continuously and have important theoretical and practical significance. Based on the present employment situation of college graduates in Shanxi Province, this paper analyzes the factors that lead to the difficulty of obtaining employment for college graduates, taking the macro-control law as the core, and comprehensively applying jurisprudence, constitutional law, labor law and economics. Based on the principles of sociology and the research results of scholars, this paper studies the employment problem of college students, and expounds the necessity of adjusting the employment problem of college students by macro-control law in combination with the provincial situation in Shanxi Province. In order to promote the employment of university graduates in Shanxi Province smoothly. The full text is divided into four parts. The first part is the basic theory of college students' employment and macro-control. By further analyzing the relationship between the employment of college students and the theory of macro-control, it is concluded that the employment of college students can be solved only when the state carries out macro-control. The second part, the macro-control policy and legal adjustment of promoting college students' employment in Shanxi Province. In this part, it analyzes the present employment situation and existing problems of Shanxi Province in recent years, as well as the policies and laws of promoting the employment of college students in Shanxi Province. It is pointed out that the existing employment policy for college students is temporary and unstable, and it is pointed out that the establishment of special employment policy and legal regulation system is the fundamental measure to solve the employment of college students. In the third part, the author analyzes the macro-control policies and laws to promote the employment of college students at home and abroad. This paper expounds and compares the employment regulation and control policies of college students in Japan and the United Kingdom, and compares and analyzes the problems and countermeasures of solving the employment of college students in the process of market economy in our country by referring to the employment promotion policies of foreign university students. It is more helpful to the science and validity of theory and policy. The fourth part, on the basis of the first three parts, the author believes that to accelerate the development of small and medium-sized enterprises in Shanxi Province, to focus on supporting industries with high knowledge and science and technology content, to increase the capacity of enterprise labor force, to strengthen the key colleges and universities in Shanxi Province, To improve the quality and comprehensive quality of students in the construction of key disciplines and specialties, to strengthen local legislation on employment for college students, to speed up the construction of local laws and regulations on the employment market for college graduates, to set up advisory bodies for equal employment supervision, and to strengthen internal and external supervision. Improve the macro-control system to provide a long-term and stable institutional guarantee for the employment of college students in Shanxi Province.
