我国被派遣劳动者权益保护研究

【摘要】:劳务派遣作为一种新型的用工形式,近年来在我国发展非常迅速。相对于传统意义上的劳动关系,劳务派遣具有其特殊性,它涉及劳务派遣单位、用工单位和被派遣劳动者三方主体,在劳务派遣中,被派遣劳动者受劳务派遣单位雇佣,却被派遣至用工单位工作,由用工单位负责提供劳动条件并对被派遣劳动者行使指挥权与管理权,这种“雇佣”与“使用”的分离使得派遣劳动者在劳务派遣关系中处于更为弱势的地位,因此,被派遣劳动者的权益保护具有特殊性和艰巨性。 《劳动合同法》、《劳动合同法实施条例》的颁布与实施,改变了之前劳务派遣无法可依的状态,在一定程度上规范了劳务派遣的运行,抑制了劳务派遣的无序发展,加强了对被派遣劳动者的权益保护。但是,《劳动合同法》在实践中也暴露出一些不足的地方,存在完善的空间。本文提出,我国应借鉴日本、德国、美国、台湾地区等劳务派遣立法经验,从我国的实际情况出发,对《劳动合同法》进行立法完善,从而有效地保护派遣劳动者的合法权益,充分发挥劳务派遣的积极作用。 本文首先阐述了研究背景及意义、国内外关于劳务派遣的研究概况,介绍了本文的研究思路和研究方法。其次对劳务派遣基本理论进行了概述,论述了劳务派遣的概念、种类及法律特征,在此基础上指出劳务派遣与其它法律关系的区别。接着评析了我国《劳动合同法》对被派遣劳动者权益的保护,指出《劳动合同法》在被派遣劳动者权益保护方面的可取之处:明确了劳务派遣三方主体之间的法律关系,规范了劳动合同及劳务派遣协议的期限,明确了被派遣劳动者的权利,规定了劳务派遣单位和用工单位应承担的责任,这都些是值得肯定之处。同时指出《劳动合同法》也存在不尽完善之处,如,关于劳务派遣单位设立、劳动报酬权、劳务派遣适用范围,以及对劳务派遣单位和用工单位的违法处罚等方面的规定还不够完善,实践中缺乏可操作性。对我国被派遣劳动者权益保护中存在的问题进行了论述和原因分析,认为目前我国被派遣劳动者权益保护问题并没有得到很好的解决,仍然存在劳动关系不稳定、滥用劳务派遣、职业安全权无法保障、不公平待遇和团结权难以实现等诸多问题,究其原因,有劳动力市场供大于求状况、劳务派遣机构的营利性质、劳动行政监管不到位和被派遣劳动者法律意识和维权能力欠缺等等。最后对我国被派遣劳动者权益保护的完善提出了建议,指出我国应借鉴日本、德国、美国、台湾地区等劳务派遣立法经验,根据我国的具体情况,从严格派遣机构的设立条件和程序、完善同工同酬规定、明确劳动派遣的适用范围、加强对劳务派遣单位的监督管理、合理分配雇主责任等方面对《劳动合同法》进行立法完善。结语部分认为必须对劳务派遣加以更为严格的规制,必须完善《劳动合同法》及相关法律法规的规定,才能更好地保护被派遣劳动者的合法权益。同时,本文提出,今后对如何单独制定《中华人民共和国劳动者派遣法》进行研究,也有其必要性。
[Abstract]:The labor dispatch as a new form of employment, developing rapidly in our country in recent years. Compared with the traditional sense of labor relations, labor dispatch has its particularity, it relates to the unit of labor dispatch, labor units and dispatched workers three parties in labor dispatch, the workers dispatched by the dispatch unit of employment, he was sent to labor units, by employing units responsible for the provision of labor conditions for dispatched workers to exercise command and management rights, the separation of "employment" and "use" of the dispatched workers in labor dispatch in a more vulnerable position, so the relationship, to protect the rights and interests of the dispatched workers are special and arduous.
"Labor contract law", "the implementation of the labor contract law promulgated and implemented the regulations on labor dispatch cannot be changed before, according to the state, to some extent regulate the labor dispatch operation, inhibited the disorderly development of labor dispatch, to strengthen the protection of the rights of dispatched workers. However, the labor contract law" in practice also exposed some deficiencies, there is room for improvement. This paper proposes that China should learn from Japan, Germany, the United States, Taiwan area labor dispatch legislation experience, starting from the actual situation of our country, the "Labor Contract Law > in legislation, so as to effectively protect the dispatched workers the legitimate rights and interests, give full play to the positive role of labor dispatch.
This paper firstly describes the research background and significance, research situation of labor dispatch at home and abroad, introduces the research ideas and research methods. Secondly, the labor dispatch basic theory are summarized and discussed the concept of labor dispatch, the type and the legal characteristic, on the basis that differences between labor dispatching and other legal relationship. Then the assessment of China's "Labor Contract Law > to protect the rights and interests of the dispatched laborers, pointed out that the" labor contract law "in the labor rights protection of the merits: clear dispatching between the three parties of the legal relationship, regulate the labor contract and the labor dispatch agreement deadline, the dispatched workers right, the provisions of the labor dispatching units and units should bear the responsibility of all these are positive." also pointed out that the labor contract law > there is not perfect, such as A labor dispatch unit, the establishment of labor remuneration right, labor dispatching scope, and the provisions of the labor dispatching units and units of illegal punishment etc is still not perfect, lack of operability in practice. The Chinese labor rights protection problems are discussed and the reason, I think at present China dispatched labor rights protection problem has not been solved, there are still unstable labor relations, the abuse of labor dispatch, occupation safety can not be guaranteed, many problems of unfair treatment and unity right is difficult to realize, the reason is the labor market oversupply situation, the for-profit labor dispatch agencies, labor administrative supervision is not in place and the dispatched workers legal consciousness and legal ability and so on. Finally, the suggestions for perfecting the protection of the rights and interests of the dispatched workers, pointed out China should learn from Japan, Germany, the United States, Taiwan area labor dispatch legislation experience, according to the specific situation of our country, from the dispatch organization strict conditions and procedures for the establishment of perfect provisions of the scope of application of equal pay for equal work, labor dispatch, strengthen supervision and management of the labor dispatch unit, a reasonable allocation of employer liability in legislation < Labor Contract Law >. The conclusion that the labor dispatch must to more stringent regulation, we must improve the provisions of < Labor Contract Law > and relevant laws and regulations, in order to better protect the legitimate rights and interests of the dispatched employees. At the same time, in this paper, the future of how to establish separate People's Republic of China Labor Dispatch Law of < > research is also necessary.
