劳动法中的违约金与赔偿金问题研究

【摘要】:在我国的《劳动法》中,并没有对违约金、赔偿金进行明确的规定,虽然关于违约金制度的研究有很多,但是涉及到劳动法领域的违约金研究则比较少,只是简单的提到;而关于赔偿金的研究,大多局限于惩罚性赔偿,还没有拓展到劳动法领域,各个方面都不完善,在这种情况下,对我国劳动法中的违约金、赔偿金相关问题进行深入研究显得很有必要。
[Abstract]:In the "Labor Law" of our country, there is no clear stipulation of liquidated damages and compensation. Although there are many researches on the system of liquidated damages, there are few researches on liquidated damages in the field of labor law, which are simply mentioned.However, most of the research on compensation is limited to punitive damages, which has not been extended to the field of labor law, and all aspects are not perfect. In this case, the penalty for breach of contract in the labor law of our country,It is necessary to study the related problems of compensation.
