我国现行劳动争议处理制度改革问题研究

【摘要】: 随着我国经济体制改革的深入,诞生于传统的计划经济向市场经济过渡过程中的劳动争议处理体制,无论在制度构建上还是在实践中都遇到了诸多问题和挑战,为此,进一步推进劳动争议处理制度的改革和发展成为我们面临的一项重要工作。本文的写作目的就在于对我国现行的劳动争议处理制度提出一些改革和完善的建议。 本文除前言和结语外,分四个部分。第一部分研究介绍了劳动争议和劳动争议处理制度的相关概念并分析了劳动争议产生的原因和劳动争议处理制度的特点。第二部分对我国现行劳动争议处理制度进行分析并指出其存在的弊端。第三部分介绍了当代西方国家的劳动争议处理制度的概况,并对其共有的规律进行分析,提出其可供借鉴之处。第四部分分析了国内关于劳动争议处理体制的各种理论,指出我国应建立“或裁或审、各自终局”的劳动争议处理模式,并在此基础上提出改革和完善我国现行劳动争议处理制度的构想。
[Abstract]:With the deepening of China's economic system reform, the labor dispute handling system born in the process of the transition from the traditional planned economy to the market economy has encountered many problems and challenges both in system construction and in practice.Further promoting the reform and development of labor dispute handling system has become an important task we are facing.The purpose of this paper is to put forward some suggestions on the reform and perfection of the current labor dispute handling system in China.In addition to the preface and conclusion, this article is divided into four parts.The first part introduces the related concepts of labor dispute and labor dispute settlement system and analyzes the causes of labor dispute and the characteristics of labor dispute settlement system.The second part analyzes the current labor dispute handling system and points out its drawbacks.The third part introduces the general situation of labor dispute handling system in contemporary western countries, analyzes its common law, and puts forward some points for reference.The fourth part analyzes various theories about the labor dispute handling system in China, and points out that China should establish the labor dispute settlement mode of "or adjudication or adjudication, respective final".On this basis, the author puts forward the idea of reforming and perfecting the current labor dispute handling system in China.
