劳动合同制度法律问题研究

【摘要】: 劳动合同调整劳动者与用人单位的权利与义务关系,促进劳动关系的和谐,是劳动法的一项基本制度。随着我国市场经济的日益发展与完善,劳动合同逐渐受到人们的重视,劳动合同制度可以成为经济发展的润滑剂,劳动者合法利益的保护伞。然而在实践中,劳动力市场还存着诸多问题,如滥用试用期、拖欠工人工资、农民工群体的权益被侵犯、对劳动者经济补偿的问题、劳动争议处理机制中的问题等等,这些问题影响了劳动市场的秩序,阻碍了经济的发展与社会的进步,所以研究劳动合同制度法律问题不仅具有理论上的价值,还有深远的现实意义。笔者从二个角度研究该问题,一方面是基本理论,另一方面是具体法律制度的研究,限于个人能力,多有不成熟之处,只希望为劳动合同制度研究尽微薄之力。
[Abstract]:It is a basic system of labor law that labor contract adjusts the relation of right and duty between laborer and unit of choose and employ persons and promotes the harmony of labor relation.With the development and perfection of the market economy in our country, the labor contract has been paid more and more attention. The labor contract system can become the lubricant of the economic development and the umbrella of the legitimate interests of the laborer.However, in practice, there are still many problems in the labor market, such as the abuse of probation period, the arrears of workers' wages, the infringement of the rights and interests of migrant workers, the problem of economic compensation to workers, the problems in the mechanism of handling labor disputes, and so on.These problems affect the order of labor market and hinder the development of economy and social progress, so the study of the legal problems of labor contract system has not only theoretical value, but also far-reaching practical significance.The author studies this problem from two angles, on the one hand, the basic theory, on the other hand, the study of the specific legal system, limited to the individual ability, most immature, only hope for the labor contract system research meagre contribution.
