劳动派遣中劳动者权益保护研究

【摘要】: 劳动派遣是派遣机构与派遣劳工订立派遣契约,在得到派遣劳工的同意后,使其在要派企业的指挥监督下提供劳务的劳动形态。“雇佣”和“使用”相分离是劳动派遣的最大特征,即派遣劳动者与派遣机构签订劳动合同,却在要派企业的指挥监督下工作。 劳动派遣的形态分为“经常雇佣型”和“登录型”两种。经常雇佣型的劳动派遣是指派遣机构将其雇佣的劳动者派至要派企业提供劳动,此种类型的派遣劳动者与派遣机构之间的劳动契约是属于不定期劳动契约。登录型的劳动派遣是指派遣机构与派遣劳动者之间并无不定期劳动关系,派遣劳动者仅是在派遣机构处登记,直到有要派企业向派遣机构提出人力需求,而该需求又符合派遣劳动者的条件时,派遣机构方与派遣劳动者签订派遣契约。我国目前大多采用登录型劳动派遣。 劳动派遣是一种新型的劳动法律关系,涉及到派遣单位、用工单位和派遣劳动者三方当事人,而目前的劳动法理论体系和框架对这些法律关系无法完全容纳和调整。因此,由于法律的缺失等一系列原因,我国派遣劳动者权益保护存在差别待遇、雇主责任落实难度加大等诸多问题。所以,我国应在对日本、美国、德国、台湾地区等有关劳动派遣制度借鉴的同时根据我国的具体情况从派遣机构的设立、劳动派遣的适用范围,劳动派遣合同的期限,雇主责任的分担,保护派遣劳动者的平等权、团结权、福利保障权、接受教育训练等方面进行劳动派遣制度设计,从而有效地保护派遣劳动者的合法权利,充分发挥劳动派遣的积极作用。
[Abstract]:Labor dispatch is the labor form in which the dispatch agency and the dispatched labor force conclude the dispatch contract and make them provide labor services under the command and supervision of the dispatching enterprise after obtaining the consent of the dispatched labor force.The separation of "employment" and "use" is the greatest characteristic of labor dispatch, that is, dispatch workers sign labor contracts with dispatch organizations, but work under the command and supervision of enterprises.The form of labor dispatch can be divided into two types: regular employment type and login type.The regular employment type of labor dispatch refers to the dispatch agency to send the workers to the enterprises to provide labor. The labor contract between this type of dispatch workers and dispatch agencies is an indefinite labor contract.Logged-in labor dispatch refers to the labor relationship between dispatch organization and dispatch worker. Dispatch worker is only registered with dispatch organization until an enterprise wants to send a manpower demand to dispatch organization.When the demand meets the conditions of dispatch workers, dispatch agencies sign dispatch contracts with dispatch workers.At present, most of our country use login labor dispatch.Labor dispatch is a new type of labor legal relationship, which involves three parties: dispatch unit, employment unit and dispatch worker. However, the current theoretical system and framework of labor law can not fully accommodate and adjust these legal relations.Therefore, due to the lack of laws and other reasons, there are many problems in the protection of the rights and interests of dispatched workers in China, such as differential treatment and the difficulty of implementing employer's responsibility.Therefore, while drawing lessons from the relevant labor dispatch systems in Japan, the United States, Germany, and Taiwan, China should, according to the specific conditions of our country, take into account the establishment of dispatch agencies, the scope of application of labor dispatch, and the duration of labor dispatch contracts.In order to protect the legal rights of the dispatched workers, the employer should design the labor dispatch system in the aspects of equal rights, solidarity rights, welfare protection rights, education and training, and so on, so as to protect the legal rights of the dispatched workers.Give full play to the positive role of labor dispatch.
