船员劳动合同之基本法律问题研究

【摘要】： 本文对涉及船员劳动合同的几个最基本的法律问题进行了阐述。首先，对于什么是船员劳动合同进行了阐述，并对于劳动关系、劳动合同、船员劳动关系、船员劳动合同法律关系等相关概念进行了介绍。其次，从船员和船舶两个方面入手，论述了如何确定船员劳动合同法律关系的问题，，其目的是为了解决未来的船员劳动法律的适用范围。接着，从对劳动力的特性和劳动力流转过程的分析入手，论述了应如何确定船员劳动合同法律关系的主体，并对船员劳动中介机构的法律地位进行了详细的论述。然后，对船员劳动合同的订立、变更、终止和解除等几个程序性问题进行了介绍。最后，对于政府在船员的劳动就业中应当如何发挥作用进行了论述。
[Abstract]:This paper expounds some basic legal problems concerning crew labor contract.First of all, what is the crew labor contract is expounded, and the related concepts such as labor relationship, labor contract, crew labor relationship, crew labor contract legal relationship and so on are introduced.Secondly, from the two aspects of crew and ship, this paper discusses how to determine the legal relationship of the crew's labor contract, the purpose of which is to solve the scope of application of the future crew's labor law.Then, starting with the analysis of the characteristics of the labor force and the process of labor flow, this paper discusses how to determine the subject of the legal relationship of the crew's labor contract, and discusses in detail the legal status of the seafarers' labor agency.Then, the conclusion, change, termination and rescission of the crew labor contract are introduced.Finally, it discusses how the government should play a role in the employment of crew.
