从“司法动员”到“街头抗议”——农民工集体行动失败的政治因素及其后果

【摘要】：作为改革开放政策的一个结果,农民工的权利问题在20世纪90年代之后得到了相关法律的承认与保护,使得他们在法律上与国营企业的工人享有同等的地位;然而,农民工的合法行动却经常遭遇失败,从而迫使他们采取更加激进的公开抗议方式。通过阐述政治过程理论的相关命题,本文假设,国家与地方相互矛盾的政策目标削弱了农民工集体行动的政治机会。这个假设可以在一定程度上解释,政治因素如何造成农民工"司法动员"的失败,而"司法动员"的失败经常导致农民工抗议的激进化。
[Abstract]:As a result of the reform and opening up policy, the rights of migrant workers were recognized and protected by the relevant laws after the 1990s, which made them legally equal to the workers in state-owned enterprises. Migrant workers often fail in their legal actions, forcing them to take a more aggressive public protest. By expounding the relevant propositions of the theory of political process, this paper assumes that the contradictory policy objectives of the state and the local government weaken the political opportunities for the collective action of migrant workers. To some extent, this hypothesis can explain how the political factors caused the failure of the "judicial mobilization" of migrant workers, which often leads to the radicalization of migrant workers' protests.
