劳动争议一裁终局制度的反思与改革

【摘要】:劳动争议一裁终局制度旨在防止用人单位滥用诉权导致劳动者权利救济不及时,将部分劳动争议案件终局于劳动仲裁程序,但对劳动者诉权并无限制。一裁终局制度作为重大改革创新之举虽然取得了一定的成效,但也凸显了诸多弊端。实践中,一裁终局案件认定标准歧义严重、分流案件效果不明显、司法程序混乱等等,影响了一裁终局制度的实施效果和立法预期。学理上也存在对裁审模式和诉权不平等性保护的认识误区,影响一裁终局制度的立法选择及其改革。一方面应重视传承现有劳动争议处理经验,完善有中国特色的一裁终局制度;另一方面,制度的建立应符合法理和现实需求。我国应从一裁终局适用标准、诉权平等、撤裁申请的立案审查、执行中止担保、分项裁决事项告知义务、强化劳动仲裁机构等方面对现有一裁终局制度进行改革和完善,使其能够真正发挥其制度功能,节约司法资源,及时实现劳动者的权利救济。
[Abstract]:The purpose of the system is to prevent the employer from abusing the right of action to prevent the laborer's right of relief from being timely, and to terminate some cases of labor dispute in the labor arbitration procedure, but there is no restriction on the right of action of the laborer. As a major reform and innovation, the final cut system has made some achievements, but it also highlights many disadvantages. In practice, the standard ambiguity of a final adjudication case is serious, the effect of diversion case is not obvious, the judicial procedure is chaotic, and so on, which affects the implementation effect and legislative expectation of the final adjudication system. In theory, there are some misunderstandings about the mode of adjudication and the unequal protection of the right of action, which influence the legislative choice and reform of the final system of adjudication. On the one hand, we should attach importance to the inheritance of the existing experience in handling labor disputes and improve the final system with Chinese characteristics; on the other hand, the establishment of the system should meet the needs of legal theory and reality. Our country should reform and perfect the existing system of the final adjudication from the aspects of the applicable standards of the final adjudication, the equality of the right of action, the filing and examination of the withdrawal application, the execution of the suspension of the guarantee, the obligation to inform the matter of the itemized adjudication, the strengthening of the labor arbitration institution, and so on. So that it can really play its system function, save judicial resources, timely realization of workers' right relief.
