【摘要】:残疾人作为一个特殊群体,其在社会的运行与中始终处于弱势地位。而这一群体在生存与发展方面,也面临着严峻的困难,他们的生活常因为身体原因受到诸多限制,遭到社会的歧视,他们的合法权利也无法得到有效的实现,这一点在就业领域表现得尤为明显。他们受到自身心理或生理条件的限制,在就业市场中的权利无法得到实现,侵犯残疾人就业权利的现象不一而足。 就业,是每一个个人维系生活的重要手段。我国宪法规定,每个公民都享有就业的权利。残疾人具有公民主体地位,也应当享有就业权利。因此,对残疾人就业权的保护,是每一个社会、政府不可推卸的责任。可以说,切实保护残疾人的就业权利,是提高残疾人社会地位,确保其生存发展的基础。只有残疾人的就业权得到了确认与保护,才能更有效地将残疾人参与到社会生活之中,共享社会发展的成果,进而促进残疾人其他权利能够有效实现。 我国现有各类残疾人总数8300多万,占总人口的7.24%,涉及2.6亿个家庭。如此庞大的残疾人群体,决定了需要对残疾人就业权的保护建立一个完善的残疾人保障法律体系,以保障和促进残疾人就业的实现。这对保护残疾人的人权,全面实现我国和谐社会的发展有着十分重要的意义。残疾人作为社会的中的一员,虽然身体或心理上受到限制,但他们仍旧享有实现自身价值、参与社会活动的愿望和权利,他们希望得到社会的广泛认同,获得与正常人同等的尊严。而对残疾人就业权给予保护,让残疾人能通过合法劳动的方式实现自身价值,正是他们实现利益诉求的前提条件。 本文主要利用比较的方法,通过对如何保护残疾人就业权问题进行探讨。首先,介绍残疾人就业权保护的历史发展,对残疾人就业权的基本内容进行阐述,分析残疾人就业权的特殊性质以及说明研究残疾人就业权的必要性。其次,列举了域外有关残疾人就业权的立法,分析他国的立法经验,探讨域外法律对我国残疾人就业权保障方面值得借鉴之处。再次,对我国残疾人就业权的现状与问题进行分析。最后,从我国的法律制度入手,,提出保障我国残疾人就业权的构想,为保护残疾人合法权益提供对策。
[Abstract]:The disabled, as a special group, are always in a weak position in the society. This group also faces severe difficulties in terms of survival and development. Their lives are often restricted by many physical reasons, discriminated against by society, and their legal rights cannot be effectively realized. This is particularly evident in the employment sector. They are restricted by their own psychological or physiological conditions, their rights in the job market can not be realized, and the phenomenon of violation of the employment rights of the disabled is numerous. Employment is an important means for every individual to maintain his or her life. Our constitution stipulates that every citizen has the right to employment. Disabled persons have the status of civil subject and should also enjoy the right to employment. Therefore, the protection of disabled employment right is every society, the government can not shirk the responsibility. It can be said that the protection of the employment rights of the disabled is the basis for improving their social status and ensuring their survival and development. Only when the employment right of the disabled is recognized and protected, can the disabled participate in the social life more effectively, share the fruits of social development, and then promote the effective realization of other rights of the disabled. The total number of disabled people in China is over 83 million, accounting for 7.24 million of the total population and involving 260 million families. Such a large group of persons with disabilities decides that it is necessary to establish a perfect legal system for the protection of disabled persons' right to employment in order to guarantee and promote the realization of employment of persons with disabilities. It is of great significance to protect the human rights of the disabled and realize the development of harmonious society in our country. Persons with disabilities, as members of society, although physically or psychologically restricted, still enjoy the desire and right to realize their own values and participate in social activities, and they wish to be widely recognized by society, Get the same dignity as normal people. The protection of disabled persons' right to employment and the realization of their own value through legal labor is the precondition for them to realize their interests. This article mainly uses the comparison method, through how to protect the disabled person's employment right question carries on the discussion. Firstly, it introduces the historical development of the protection of the disabled's right to employment, expounds the basic contents of the right to employment of the disabled, analyzes the special nature of the right to employment of the disabled and explains the necessity of studying the employment right of the disabled. Secondly, it enumerates the legislation on the employment right of the disabled outside China, analyzes the legislative experience of other countries, and probes into the aspects of the protection of the employment right of the disabled in our country. Thirdly, the present situation and problems of employment right of disabled people in China are analyzed. Finally, starting from the legal system of our country, the author puts forward the idea of protecting the disabled persons' right to employment in order to provide countermeasures for protecting the legal rights and interests of the disabled.
