隐蔽型劳务派遣的法律规制研究

【摘要】:劳务派遣作为一种灵活用工形式,在为我国带来就业便利,促进劳动力市场快速发展的同时,也致使我国面临劳动关系的复杂化和多元化等问题,冲击着传统的劳动关系。随着我国劳动法律体系不断完善,对劳务派遣的法律规制日趋严格,游离在民法与劳动法之间的外包用工大有取代劳务派遣用工成为企业新的规定用工责任的方式的趋势。劳务派遣用工成本和法律风险增加、外包的法律缺陷、劳务派遣与劳务外包都涉及三方关系且表现形式相似等原因促使了"假外包、真派遣”现象的产生。隐蔽型劳务派遣以劳务外包形式掩盖劳务派遣的实质,人为的使两种用工模式交织在一起,扭曲了正常用工秩序,给劳动者和劳动力市场带来了诸多不利影响,使得《劳动合同法》以及《劳务派遣暂行规定》规范劳务派遣用工行为,切实维护劳务派遣工人的合法权益无法落实,规制隐蔽型劳务派遣行为迫在眉睫。为了规制这一不当劳务派遣用工现象,《劳务派遣暂行规定》第二十七条做出了相关规定,但该规定看似给了判断劳务外包与劳务派遣的标准,即将隐蔽型劳务派遣认定为劳务派遣,但是该规定过于宽泛,没有实际可操作性,隐蔽型劳务派遣的认定成为司法实践中的一大难题。有鉴于此,本文提出了规制隐蔽型劳务派遣的立法及司法建议。在立法层面上完善外包与劳务派遣的概念界定,明晰外包用工中劳动法责任主体及法律责任,扩大劳务派遣连带责任主体范围;在执法层面上,加强对劳务派遣的监管和引导
[Abstract]:As a flexible employment form, labor dispatch not only brings employment convenience to our country and promotes the rapid development of labor market, but also makes our country face the problems of complexity and diversification of labor relations, which impact on the traditional labor relations. With the perfection of labor law system in our country, the legal regulation of labor dispatch is becoming more and more strict. The outsourced labor between civil law and labor law has a tendency to replace labor dispatch as a new way of regulating the responsibility of labor. The increase of labor cost and legal risk of labor dispatch, the legal defects of outsourcing, the tripartite relationship between labor dispatch and labor outsourcing, and the similar form of expression make the phenomenon of "false outsourcing, true dispatch" come into being. The covert type of labor dispatch hides the essence of labor dispatch in the form of labor outsourcing, artificially interweaves the two patterns of employment, distorts the normal order of employment, and brings a lot of adverse effects to the labor force and the labor market. It is urgent to regulate the labor dispatch behavior in the Labor contract Law and the temporary provisions of Labor dispatch, to safeguard the legitimate rights and interests of the labor dispatch workers, and to regulate the covert labor dispatch behavior. In order to regulate the phenomenon of improper labor dispatch, Article 27 of "temporary provisions on Labor dispatch" makes relevant provisions, but this provision seems to give the standard of judging labor outsourcing and labor dispatch. The covert labor dispatch will be recognized as labor dispatch, but this provision is too broad, no practical operation, the identification of hidden labor dispatch has become a major problem in judicial practice. In view of this, this paper puts forward legislative and judicial suggestions to regulate hidden labor dispatch. At the legislative level, we should perfect the definition of the concept of outsourcing and labor dispatch, clarify the subject of labor law responsibility and legal responsibility, expand the scope of joint liability of labor dispatch, and strengthen the supervision and guidance of labor dispatch on the level of law enforcement.
