劳动者自发维权组织的法律困境及其解决

【摘要】:我国现行劳动法律并没有对劳动者自发维权组织作出具体规定,然而规范劳动者自发维权组织既有利于多渠道保障劳动者权益,也有利于实现劳资纠纷非暴力解决,因而有必要在法律中确立劳动者自发维权组织制度。 笔者为劳动者自发维权组织进行概念界定,并归纳现阶段我国劳动者自发维权组织现状以及分析其产生的原因。 根据现状,笔者概括出劳动者自发维权组织面临的五大法律困境,即主体合法性待定;主体独立性模糊;组织权利义务界定不明晰;组织治理结构不规范以及组织维权成果无保障,本文逐一对上述法律困境进行分析。 本文的新意在于解决劳动者自发维权组织五大法律困境。笔者在检索国内现有文献并综合借鉴日本、德国、英国及我国台湾地区学者学说的基础上,借鉴域外法,结合我国现有法律,提出通过增设法律条款以赋予劳动者自发维权组织法律合法性,并通过转变政府职能等维护劳动者自发维权组织独立性,设定制度保障维权成果。同时,本文还为劳动者自发维权组织量身定制权利义务以及参考公司制度设计劳动者自发维权组织的治理机构以便其规范运作。通过劳动者自发维权组织外部环境和内部环境双管齐下提出解决思路来完善健全组织合法性;明确认定组织独立性;切实保障组织维权成果;清晰界定组织权利义务;规范设计组织治理结构。根据不同的法律困境,笔者设计不同的途径,从而保证劳动者自发维权组织具体可操作。
[Abstract]:The current labor law of our country has not made the concrete stipulation to the laborer's spontaneous rights organization. However, standardizing the laborer's spontaneous rights organization is not only beneficial to protect the rights and interests of the laborer through many channels, but also beneficial to the non-violent settlement of the labor dispute. Therefore, it is necessary to establish the system of workers' spontaneous rights-safeguarding organizations in the law. The author defines the concept of the workers' spontaneous rights organization, and sums up the present situation of the workers' spontaneous rights organization in our country and analyzes the reasons for its emergence. According to the present situation, the author generalizes the five legal dilemmas that workers' spontaneous rights organizations are facing, that is, the legitimacy of the subject is to be determined, the independence of the subject is vague, the definition of the rights and obligations of the organization is not clear; The organization governance structure is not standard and the organization rights protection achievement is not guaranteed, this paper analyzes the above legal dilemma one by one. The new idea of this paper is to solve the five legal dilemmas of the workers'spontaneous rights organizations. On the basis of retrieving the existing domestic literature and synthetically learning from the scholars' theories of Japan, Germany, Britain and Taiwan, the author draws lessons from the extraterritorial law and combines the existing laws of our country. It is proposed that the legal legitimacy of workers' spontaneous rights organizations should be given by adding legal provisions, and the independence of workers' spontaneous rights organizations should be safeguarded by changing the functions of the government, and the system should be set up to guarantee the achievements of safeguarding rights. At the same time, this paper also customizes the rights and obligations for the workers' spontaneous rights organizations and designs the governance institutions of the workers' spontaneous rights organizations in order to regulate their operation. Through the laborer's spontaneous rights organization external environment and the internal environment two ways of thinking are put forward to perfect and perfect the organization legitimacy; clearly identify the organizational independence; ensure the organization rights protection achievements; clearly define the organization rights and obligations; Standardize the design of organizational governance structure. According to the different legal dilemma, the author designs different ways to ensure the laborers' spontaneous organization can be operated.
