外国人在华非法就业问题的法律规制研究

【摘要】:外国人在华非法就业问题与外国人非法入境、非法居留并称“三非”问题,它已经发展成我国目前一个十分突出的社会管理问题。而导致外国人非法就业问题的根本原因除了我国经济飞速发展带来了较多就业机会之外,更主要的还是我国针对外国人就业的法律规制体系存在问题。为了从制度层面解决外国人非法就业问题,加强对外国人非法就业进行法律规制问题的研究就有着现实必要性与紧迫性。目前,世界各国普遍建立了较为完善的外国人就业管理法律制度对国内外国劳工就业进行规范。作为非移民国家,我国现行外国人就业管理制度体系并不完善,仅仅对国际劳工中具有专业技术外国人员的劳动就业进行规范,即便中国式“绿卡”制度也采取有条件地实行从国际劳工向永久居留资格转变的方式。外国人就业管理制度理应与移民取向相并行,但现行管理制度并不符合我国发展现状,对外国人就业管理制度进行完善势在必行。 本篇论文主要分为四个部分。第一章论述了外国人就业管理的基本概念和理论,指出外国人非法就业是指没有取得定居权的外国人在中国境内依法从事社会劳动并获取劳动报酬的行为。另外本章对外国人在华就业与非法移民的联系与区别、非法就业的危害进行阐述,并结合我国国情分析外国人非法就业的成因,指出进一步规范和完善我国外国人就业管理制度的必要性和紧迫性;第二章对外国人就业的法律规制的现状进行了介绍,包括外国人在华就业的基本法律及相关的规章制度,同时对于针对外国人就业管理的职能部门和具体职责进行了具体的介绍,明确我国外国人就业管理制度的基本构架;第三章介绍了我国现行的外国人就业管理制度所存在的问题,分别从立法内容、执法水平、司法救济等几个方面展开论述,为下文针对性地提出解决方案做理论铺垫,,第四章是完善我国出入境管理制度的行政法对策与建议,分别从立法、执法、司法等几个方面结合我国当前的现实国情和已经取得外国人就业管理制度经验,为我国确立制度准则提供参考,继而在立法措施、运行机制、调控手段等方面对就业管理制度予以完善。
[Abstract]:The problem of illegal employment of foreigners in China and the illegal entry and residence of foreigners in China, which has developed into a very prominent social management problem in China. In addition to the rapid development of our economy, the main reason for the problem of illegal employment of foreigners is that there are problems in the legal regulation system of employment of foreigners in our country. In order to solve the problem of illegal employment of foreigners from the system level, it is necessary and urgent to strengthen the research on the legal regulation of illegal employment of foreigners. At present, the countries all over the world have established relatively perfect foreign employment management legal system to regulate the domestic and foreign labor employment. As a non-immigrant country, the current employment management system of foreigners in China is not perfect, and it only regulates the employment of foreign workers with professional skills in the international labor force. Even the Chinese green card system adopts a conditional shift from international labor to permanent residency. The employment management system of foreigners should be parallel with the orientation of immigrants, but the current management system does not accord with the present situation of our country, so it is imperative to perfect the management system of employment for foreigners. This paper is divided into four parts. The first chapter discusses the basic concept and theory of foreigners' employment management, and points out that illegal employment of foreigners refers to the behavior of foreigners who have not obtained the right to settle in China to engage in social work and get paid for their work according to law. In addition, this chapter expounds the relations and differences between the employment of foreigners in China and illegal immigrants, the harm of illegal employment, and analyzes the causes of illegal employment of foreigners in the light of the national conditions of our country. The author points out that it is necessary and urgent to further standardize and perfect the employment management system of foreigners in China. Chapter two introduces the current situation of the legal regulation on the employment of foreigners, including the basic laws and relevant rules and regulations on the employment of foreigners in China. At the same time, it introduces the functional departments and specific responsibilities of the employment management of foreigners, and clarifies the basic framework of the employment management system of foreigners in China. The third chapter introduces the existing problems of the foreign employment management system in China, respectively from the legislative content, the level of law enforcement, judicial relief and other aspects of the discussion, for the following targeted solutions to do theoretical foreshadowing, The fourth chapter is the administrative law countermeasures and suggestions to perfect our country's entry and exit management system, which combines the current situation of our country and the experience of foreigners' employment management system from the aspects of legislation, law enforcement, judicature and so on. It provides the reference for establishing the system standard of our country, then consummates the employment management system in the legislative measure, the operation mechanism, the control method and so on.
