国际劳工组织及其隐蔽雇佣关系立法研究

【摘要】:雇佣关系是一个世界各国广泛使用的法律概念,其一直是并将继续是工人赖以在劳动法和社会保障领域获得与就业相关的权利和利益的主要载体,也是确定雇主对工人的权利和义务的性质和范围的关键参照点。但是,随着劳动力市场上隐蔽雇佣关系的出现,如何对其进行法律规制成为现代劳动法的主要任务。在我国,对雇佣关系的法律调整仍存在制度性缺失。因此,研究雇佣关系的基本理论,分析国际及国外的立法动态,为完善我国劳动关系立法体系提供必要理论支撑和模式参考就成为当前和今后法学界的一大理论课题。 文章主要运用逻辑分析的方法、理论联系实际、注重对隐蔽雇佣关系的基本理论和基本内容的研究,在提出问题、分析问题的基础上,提出了解决问题的具体对策。本论文共有五个部分组成,其主要内容如下: 文章的第一部分主要介绍了本论文的写作背景及研究意义,同时概述了国内外学者对相关问题的研究现状。 文章第二部分介绍了国际劳工组织机构及其最新立法动态,进一步阐述中国与国际劳工组织的关系及《2006雇佣关系建议书》对中国可能产生的影响。 文章在第三部分以产业革命作为切入点,考查雇佣关系法律调整的历史演进,论证了劳动法的调整对象主要是产业雇佣关系。同时进一步分析了产业雇佣关系的主体及其权利、义务。 文章的第四部分,,具体分析了隐蔽雇佣关系的含义、主要类型、存在形式、法律特征。在此基础上阐述隐蔽雇佣关系存在的社会价值及其存在的法律问题。 文章的第五部分,在分析我国隐蔽雇佣关系现状和问题的基础上,阐述了我国隐蔽雇佣关系立法的必要性,最后提出了完善劳动关系立法规制隐蔽雇佣关系的具体对策。
[Abstract]:Employment relationship is a legal concept widely used by countries all over the world. It has been and will continue to be the main carrier for workers to obtain employment-related rights and benefits in the field of labor law and social security. It is also a key reference point for determining the nature and scope of employer's rights and obligations towards workers. However, with the emergence of covert employment relationship in the labor market, how to regulate it legally becomes the main task of modern labor law. In our country, there are still institutional deficiencies in the legal adjustment of employment relations. Therefore, to study the basic theory of employment relationship, analyze the international and foreign legislative trends, and provide the necessary theoretical support and model reference for the improvement of China's labor relations legislation system has become a major theoretical topic in the current and future legal circles. This paper mainly uses the method of logic analysis, combining theory with practice, pays attention to the study of the basic theory and basic content of covert employment relationship, puts forward the concrete countermeasure to solve the problem on the basis of putting forward the problem and analyzing the problem. This thesis is composed of five parts, the main contents are as follows: The first part mainly introduces the writing background and research significance of this paper, and summarizes the current situation of domestic and foreign scholars on related issues. The second part of the article introduces the organization of the International Labour Organization (ILO) and its latest legislative developments, and further expounds the relationship between China and the ILO and the possible impact of < 2006 recommendation on Employment Relations on China. In the third part, taking the industrial revolution as the starting point, the article examines the historical evolution of the legal adjustment of the employment relationship, and proves that the object of the adjustment of labor law is mainly the industrial employment relationship. At the same time, it further analyzes the subject of industrial employment relationship and its rights and obligations. The fourth part analyzes the meaning, main types, forms and legal characteristics of covert employment relationship. On this basis, the social value of covert employment relationship and its legal problems are expounded. The fifth part of the article, on the basis of analyzing the current situation and problems of the covert employment relationship in our country, expounds the necessity of the covert employment relation legislation in our country, and finally puts forward the concrete countermeasures to perfect the labor relation legislation to regulate the covert employment relationship.
