《劳动合同法》的立法技艺——一个法律经济学的分析

【摘要】:法律所提供的制度框架改变、强化市场主体的利益结构,并以此改变、指引人们的行为。《劳动合同法》改变了用人单位的成本收益结构,有利于该法的实施。但劳动合同的性质决定其强烈依赖于国家提供的第三方保护,因此完善劳动争议解决机制以降低劳动者寻求救济的交易成本是贯彻落实《劳动合同法》的关键。
[Abstract]:The institutional framework provided by the law changes, strengthens the interest structure of the market subject, and guides people's behavior. The Labor contract Law has changed the structure of cost and income of the employer, which is beneficial to the implementation of the law. However, the nature of labor contract strongly depends on the third party protection provided by the state. Therefore, it is the key to carry out the Labor contract Law to perfect the labor dispute settlement mechanism to reduce the transaction cost of workers seeking relief.
