开除与惩戒性解除劳动合同的选择

【摘要】:用人单位对有重大过错行为的职工的处理有两种方式,一种是开除,一种是惩戒性解除劳动关系。两种处理方式有其共同点,也有不同之处,两者最大的区别是开除只适用于国有单位。而开除所依据的《企业职工奖惩条例》现在看来已不适应市场经济发展的需要了,国家应对有关规定作出调整。
[Abstract]:The unit of choose and employ persons has two ways to deal with the workers who have serious fault, one is to expel, the other is to release the labor relation. There are similarities and differences between the two approaches. The biggest difference is that expulsion only applies to state-owned units. However, the regulations on rewards and punishments for Enterprise employees, which are based on dismissal, now seem to have failed to meet the needs of the development of the market economy, and the state should adjust the relevant provisions.
