大学生校外兼职劳动权益保障相关问题研究

【摘要】：随着大学生利用课余时间在校外兼职现象越来越普遍,其对大学生的个人素质培养和社会实践能力都大有裨益,但是兼职过程中大学生与用人单位之间的矛盾也逐渐凸显,劳动权益往往无法得到切实保障,遭受损害的情况屡屡出现。本文结合社会学理论方法,通过调查问卷的形式引出大学生校外兼职现象,列明大学生校外兼职的种类、原因和所遭遇的问题,以及在困境之后如何选择救济。总结调查数据得出大学生校外兼职易受侵害的原因,个人维权意识和法律素养偏低,立法缺失,高校和社会监管不得当等。对于大学生这一特殊群体校外兼职劳动权益保障是当下亟待解决的重要问题,通过国内外关于大学生兼职是否符合劳动者身份这一主要争议进行理论梳理,借鉴外国对大学生兼职的劳动保障经验,提出相应的完善建议。从实践出发,通过立法完善、高校指导、社会重视等手段,来解决当下大学生校外兼职遭受侵害所面临的维权困境这一难题。
[Abstract]:As college students use their spare time in part-time part-time phenomenon more and more common, it is of great benefit to the individual quality training and social practice ability of college students, but the contradiction between the college students and the employers is becoming more and more obvious in the part-time process, and the labor rights and interests often cannot be guaranteed. According to the theory and method of sociology, the paper leads to the phenomenon of part-time part-time college students through the questionnaire. It lists the types of part-time part-time college students, the reasons and the problems encountered, and how to choose relief after the difficult situation. On the low side, the legislation is missing, the University and the social supervision can not be used. The protection of the part-time labor rights and interests outside the school for the college students is an important problem to be solved urgently. Through the theory of the main dispute about whether the part-time job is in line with the identity of the laborers at home and abroad, we can draw lessons from the foreign labor guarantee for the part-time students. Experience, put forward the corresponding suggestions. From the practice, through the legislative improvement, University guidance, social attention and other means, to solve the problem of the right dilemma faced by college students outside school part-time employment.
